云南省政法經(jīng)費(fèi)保障狀況研究

【摘要】:改革開放三十年來(lái),我國(guó)的財(cái)政體制幾經(jīng)改革,對(duì)包括政法部門在內(nèi)的各級(jí)黨政機(jī)關(guān)均實(shí)行“分級(jí)管理、分級(jí)負(fù)擔(dān)”的經(jīng)費(fèi)保障體制。從政法經(jīng)費(fèi)保障情況看,這一體制為確保政法部門履行職能發(fā)揮了積極作用。但隨著我國(guó)經(jīng)濟(jì)和社會(huì)事業(yè)的快速發(fā)展,各項(xiàng)改革的不斷深化,政法工作面臨著前所未有的新情況、新問(wèn)題,表現(xiàn)在政法經(jīng)費(fèi)保障方面,主要是發(fā)展不平衡問(wèn)題,也就是基層政法機(jī)關(guān)困難問(wèn)題。因此,黨的十六屆六中全會(huì)關(guān)于構(gòu)建社會(huì)主義和諧社會(huì)若干重大問(wèn)題的決定中,對(duì)于如何完善公共財(cái)政制度,向財(cái)政部門提出了新的要求,包括:健全公共財(cái)政體制,進(jìn)一步明確中央和地方的事權(quán),健全財(cái)力與事權(quán)相匹配的財(cái)稅體制;加大財(cái)政轉(zhuǎn)移支付力度,促進(jìn)轉(zhuǎn)移支付規(guī)范化、法制化;保障各級(jí)政權(quán)建設(shè)需要,著力解決縣鄉(xiāng)財(cái)政困難,增強(qiáng)基層政府提供公共服務(wù)的能力,努力實(shí)現(xiàn)基本公共服務(wù)的均等化等等。而政法經(jīng)費(fèi)保障體制改革的目標(biāo)設(shè)計(jì),就是自2009年起實(shí)施政法經(jīng)費(fèi)保障體制改革,著力提高縣級(jí)政法機(jī)關(guān)的經(jīng)費(fèi)保障水平,通過(guò)中央和省級(jí)安排政法轉(zhuǎn)移支付資金,縮小縣級(jí)與市級(jí)、省級(jí)保障水平的差距,使縣級(jí)政法機(jī)關(guān)不因本級(jí)政府財(cái)力的不足而影響辦案,影響政法職責(zé)的正常履行。 云南省政法經(jīng)費(fèi)保障體制改革歷經(jīng)五年,在各級(jí)財(cái)政部門和政法部門應(yīng)共同努力,一方面認(rèn)真做好了本省各級(jí)政法機(jī)關(guān)的經(jīng)費(fèi)保障工作,通過(guò)調(diào)整財(cái)政收支結(jié)構(gòu),加大財(cái)政轉(zhuǎn)移支付力度等一系列措施,逐步提高經(jīng)濟(jì)不發(fā)達(dá)地區(qū)的政法機(jī)關(guān)經(jīng)費(fèi)保障水平;另一方面加強(qiáng)了對(duì)政法經(jīng)費(fèi)的管理,完善制度,提高資金的使用效益。在增加投入和加強(qiáng)管理雙管齊下的基礎(chǔ)上,云南省政法部門執(zhí)法水平和辦案能力顯著提高,確保了云南省經(jīng)濟(jì)社會(huì)持續(xù)穩(wěn)定和不斷發(fā)展。但在各項(xiàng)改革工作取得成效的同時(shí),也陸續(xù)反映了一些實(shí)際工作中遇到的困難與問(wèn)題,主要表現(xiàn)在以下幾個(gè)方面:一是政法部門業(yè)務(wù)工作量不斷加大,經(jīng)費(fèi)需求量不斷增加;二是部分財(cái)力差的縣級(jí)仍存在投入不足的問(wèn)題;三是“收支兩條線”管理問(wèn)題沒有根本解決;四是業(yè)務(wù)裝備管理亟待加強(qiáng);五是政法部門改革監(jiān)管環(huán)節(jié)有待完善。 針對(duì)存在問(wèn)題提出了云南省加強(qiáng)政法經(jīng)費(fèi)財(cái)政收支預(yù)算管理的對(duì)策措施。一是建立有效的政法經(jīng)費(fèi)保障投入機(jī)制;二是明確各地政法經(jīng)費(fèi)保障責(zé)任;三是研究出臺(tái)加強(qiáng)政法機(jī)關(guān)組織收入管理的措施;四是進(jìn)一步提高業(yè)務(wù)裝備經(jīng)費(fèi)的管理水平;五是完善內(nèi)部監(jiān)督,強(qiáng)化政法經(jīng)費(fèi)支出管理;六是加強(qiáng)政法經(jīng)費(fèi)保障體制改革的績(jī)效評(píng)價(jià)。 本文采用理論分析與實(shí)踐分析相結(jié)合的分析方法,按照“研究現(xiàn)狀、分析問(wèn)題、解決問(wèn)題”的研究思路,對(duì)云南省加強(qiáng)政法經(jīng)費(fèi)保障體制改革財(cái)政收支預(yù)算管理開展了研究,以期為政策研究和制定提供一定的理論依據(jù)和參考。
[Abstract]:In the past 30 years of reform and opening up, the financial system of our country has been reformed several times, and the party and government organs at all levels, including the political and legal departments, have been under the system of "classified management and hierarchical burden".This system plays an active role in ensuring the political and legal departments to perform their functions.However, with the rapid development of our country's economic and social undertakings and the deepening of various reforms, the political and legal work is facing unprecedented new conditions, new problems, manifested in the political and legal funding guarantee, mainly the development imbalance.That is, the basic political and legal organs are difficult.Therefore, in the decision of the sixth Plenary session of the 16th CPC Central Committee on several important issues concerning the construction of a harmonious socialist society, new requirements have been put forward to the financial departments on how to improve the public finance system, including: improving the public finance system.To further clarify the power of the central and local governments, to improve the fiscal and taxation system that matches the financial resources with the administrative powers, to increase the intensity of financial transfer payments, to promote the standardization and legalization of transfer payments, to safeguard the needs of political power construction at all levels, and to make efforts to solve the financial difficulties of counties and townships.To enhance the capacity of grass-roots governments to provide public services, and strive to achieve equalization of basic public services, and so on.The objective design of the reform of the political-legal funds guarantee system is to implement the reform of the political-legal funds guarantee system since 2009, to focus on raising the level of the funds guarantee for the county-level political and legal organs, and to transfer and pay funds through the central and provincial arrangements for political-legal arrangements.In order to narrow the gap between county level and city level and the level of provincial security, the county-level political and legal organs will not affect the handling of cases and the normal performance of their political and legal duties because of the lack of financial resources of their respective governments.After five years of reform of the political and legal funds guarantee system in Yunnan Province, the financial departments and the political and legal departments at all levels should make joint efforts. On the one hand, they have done a good job of ensuring the funds of the political and legal organs of the province at all levels, and by adjusting the structure of their financial revenues and expenditures,A series of measures, such as increasing the intensity of financial transfer payment, have been taken to gradually raise the level of fund guarantee for political and legal organs in economically underdeveloped areas, on the other hand, to strengthen the management of political and legal funds, to perfect the system, and to improve the efficiency of the use of funds.On the basis of increasing investment and strengthening management, the law enforcement level and the ability of handling cases of Yunnan's political and legal departments have been improved significantly, which has ensured the sustained stability and continuous development of Yunnan's economy and society.However, with the success of the reform work, the difficulties and problems encountered in the practical work have been reflected in succession, mainly in the following aspects: first, the business workload of the political and legal departments is constantly increasing, and the demand for funds is constantly increasing;Second, the county level with poor financial resources still has the problem of insufficient investment; third, the management of "two lines of income and expenditure" has not been fundamentally resolved; fourth, the management of business equipment needs to be strengthened urgently; and fifth, the reform and supervision of the political and legal departments need to be improved.In view of the existing problems, this paper puts forward some countermeasures to strengthen the budget management of the political and legal funds in Yunnan Province.One is to establish an effective input mechanism of political-legal funds, the other is to clarify the responsibility of political-legal funds guarantee; third, to study the measures to strengthen the organizational income management of political and legal organs; fourth, to further improve the management level of operational equipment funds;Fifth, to improve internal supervision and strengthen the management of the expenditure of political and legal funds; sixth, to strengthen the performance evaluation of the reform of the political and legal funds guarantee system.In this paper, with the method of combining theoretical analysis with practical analysis, and according to the research ideas of "current research, analysis of problems, solving problems", this paper has carried out a study on the reform of the budget management of revenue and expenditure in Yunnan Province by strengthening the system of political and legal funds guarantee.In order to provide a certain theoretical basis and reference for policy research and formulation.
