【摘要】：發(fā)展軍民兩用技術(shù)一直是世界各國國防科技政策的重要內(nèi)容。技術(shù)產(chǎn)權(quán)的界定、合理配置及交易問題關(guān)系到技術(shù)產(chǎn)權(quán)本身的效率與引領(lǐng)創(chuàng)新的作用。合理配置軍民兩用技術(shù)產(chǎn)權(quán),完善立法保障,發(fā)揮政府主導(dǎo)作用,可以充分保障軍民兩用技術(shù)產(chǎn)權(quán)各權(quán)利主體的利益。只有實現(xiàn)了利益科學(xué)合理的分配并滿足不同主體的需求,才能激勵國防科技的持續(xù)創(chuàng)新,確保國家國防技術(shù)安全。
[Abstract]:The development of dual-use technology has been an important part of national defense science and technology policy all over the world. The definition, rational allocation and transaction of technology property right are related to the efficiency of technology property right and the function of leading innovation. Reasonable allocation of dual-use technology property rights, perfect legislative protection, and give play to the leading role of the government, can fully protect the interests of the main rights of dual-use technology property rights. Only by realizing the scientific and reasonable distribution of interests and satisfying the needs of different subjects can we encourage the continuous innovation of national defense science and technology and ensure the security of national defense technology.
