中國食品安全法律規(guī)制的完善研究

【摘要】:食品安全是當(dāng)下全球共同關(guān)注和研討的重要課題。食品為人類提供賴以生存的物質(zhì)條件,關(guān)系著全人類的生命健康權(quán)利,是影響國家發(fā)展和社會(huì)穩(wěn)定的重要因素。 我國的食品安全事件時(shí)有發(fā)生。雖然自《食品安全法》出臺(tái)以來,國家在治理食品安全問題上不遺余力,重典、重拳出擊。然而,當(dāng)前我國在食品安全立法和執(zhí)法上仍存在一些問題,導(dǎo)致事故頻發(fā)。我國在食品安全立法上存在的主要缺陷有:法律體系缺乏系統(tǒng)性和完整性,未解決相關(guān)法律的銜接和沖突問題;配套的食品安全法律制度缺失或者不夠完善;執(zhí)法上存在的問題主要有:當(dāng)前的食品安全監(jiān)管體制仍有缺陷,監(jiān)管部門“條塊分割、各自為政”,且地方政府的“地方保護(hù)”現(xiàn)象嚴(yán)重;執(zhí)法過程缺乏規(guī)范性和持續(xù)性,執(zhí)法能力不強(qiáng)。 國外發(fā)達(dá)國家和地區(qū)的食品安全法律體系發(fā)展比較完善。如美國、歐盟、日本普遍以風(fēng)險(xiǎn)危害性分析為基礎(chǔ),立法涉及對(duì)食品的全過程控制;執(zhí)法監(jiān)管分工明確、協(xié)調(diào)一致,且有完善的食品安全監(jiān)管責(zé)任追究制度,可供我們借鑒和學(xué)習(xí)。 我國應(yīng)在借鑒和吸收國外食品安全法律制度的基礎(chǔ)上,結(jié)合我國國情,從立法和執(zhí)法兩方面完善我國的食品安全法律體系。立法方面包括健全食品安全法律法規(guī)、完善食品安全風(fēng)險(xiǎn)評(píng)估制度、食品溯源制度、食品召回制度,統(tǒng)一食品安全標(biāo)準(zhǔn),形成科學(xué)、權(quán)威的食品安全國家標(biāo)準(zhǔn);執(zhí)法方面包括加強(qiáng)監(jiān)管執(zhí)法體系的完善,落實(shí)監(jiān)管責(zé)任機(jī)制、加大行政問責(zé)力度,,依法嚴(yán)懲食品安全違法犯罪行為。通過對(duì)我國食品安全立法和執(zhí)法的完善,以期實(shí)現(xiàn)對(duì)食品安全領(lǐng)域的有效規(guī)制,推動(dòng)食品安全形勢持續(xù)好轉(zhuǎn)。
[Abstract]:Food safety is an important topic of global concern and discussion.Food provides human beings with the material conditions on which to live, which is related to the right to life and health of all mankind and is an important factor affecting national development and social stability.Food safety incidents occur from time to time in our country.Although since the introduction of the Food Safety Law, the country has spared no effort in managing food safety issues.However, there are still some problems in food safety legislation and law enforcement in China, which leads to frequent accidents.The main defects of food safety legislation in China are: the lack of systematization and integrity of the legal system, the failure to solve the problems of the connection and conflict of relevant laws, the lack or imperfection of the supporting food safety legal system;The main problems in the law enforcement are: the current food safety supervision system is still flawed, the supervision department is "fragmented, separate", and the local government's "local protection" phenomenon is serious, the law enforcement process lacks standardization and sustainability,The law enforcement ability is not strong.The food safety law system of foreign developed countries and regions is relatively perfect.For example, the United States, the European Union and Japan are generally based on risk hazard analysis. Legislation involves the control of the whole process of food; the division of labor in law enforcement and supervision is clear, coordinated, and there is a perfect accountability system for food safety supervision.For our reference and learning.On the basis of drawing lessons from and absorbing the foreign food safety law system, our country should perfect our food safety law system from the aspects of legislation and law enforcement.The legislation includes improving food safety laws and regulations, perfecting food safety risk assessment system, food traceability system, food recall system, unified food safety standards, forming scientific and authoritative national standards for food safety;In the aspect of law enforcement, we should strengthen the system of supervision and law enforcement, implement the mechanism of supervision responsibility, strengthen administrative accountability, and severely punish the illegal and criminal behavior of food safety according to law.Through perfecting the legislation and law enforcement of food safety in China, we hope to realize the effective regulation in the field of food safety and promote the situation of food safety to improve continuously.
