【摘要】：企業(yè)在運行過程中,機遇與風險并存,企業(yè)法律風險貫穿于企業(yè)經(jīng)營管理始終,貫穿于企業(yè)生命周期始終。隨著高風險時代的到來,隨著市場競爭的不斷加劇,重視和加強企業(yè)法律風險管理成為企業(yè)增強市場競爭優(yōu)勢的基礎(chǔ)性工作,成為增強企業(yè)生存發(fā)展能力的重要途徑,成為推動企業(yè)自身改革發(fā)展的重要保障。本論文全文共包括理論分析和實證性研究兩大部分內(nèi)容。理論部分(第一、二章)主要對企業(yè)法律風險管理的概念特征、類型、管理過程及實施進行理論分析,對我國企業(yè)法律風險管理發(fā)展歷程及現(xiàn)狀進行必要論述,重點著眼于國有企業(yè)法律風險管理,闡明國有企業(yè)開展法律風險管理的重要性必要性,為實證性研究部分奠定理論基礎(chǔ)。實證性研究(第三章至第五章)以寧夏NETC公司(國有企業(yè))為研究對象,以法律風險管理理論為工具,運用問卷調(diào)查、案例剖析,法律風險識別分析評估框架等方法,發(fā)現(xiàn)查找該企業(yè)在法律風險管理中存在的問題和不足,分析原因,提出對策措施,制定改進方案,以期為推動和促進該企業(yè)改進提高法律風險管理工作盡綿薄之力。
[Abstract]:In the process of operation, opportunity and risk coexist, and legal risk runs through the management and life cycle of the enterprise. With the arrival of the high risk era, the market competition is becoming more and more serious. To pay attention to and strengthen the legal risk management of enterprises has become the basic work for enterprises to enhance their competitive advantage in the market and an important way to enhance their ability to survive and develop. This thesis includes two parts: theoretical analysis and empirical research. Theoretical part (first). The second chapter mainly analyzes the concept characteristics, types, management process and implementation of the enterprise legal risk management, and discusses the development process and current situation of the enterprise legal risk management in our country. Focusing on the legal risk management of state-owned enterprises, the importance of carrying out legal risk management in state-owned enterprises is expounded. The empirical study (chapter III to chapter 5th) takes Ningxia NETC Company (state-owned enterprises) as the research object, taking the legal risk management theory as the tool, using the questionnaire. Case analysis, legal risk identification analysis and evaluation framework, find out the problems and shortcomings in the legal risk management of the enterprise, analyze the reasons, put forward countermeasures, formulate improvement plan. In order to promote and promote the enterprise to improve the legal risk management work.
