地方政府管理模式變革路徑研究

【摘要】：本文以上海自貿(mào)區(qū)負(fù)面清單管理模式為例,研究探討地方政府管理模式變革的路徑。負(fù)面清單管理模式的運(yùn)作原理理論表述很簡單,但在實踐上,對于政府和公務(wù)人員來說,從管理模式、思維習(xí)慣和利益調(diào)整等諸方面會形成較多的震動與沖擊。如何在全國推廣負(fù)面清單模式,國內(nèi)既缺乏成熟的理論指導(dǎo),又缺乏現(xiàn)成的實踐經(jīng)驗,這是上海自貿(mào)區(qū)先行先試的重任所在,也是本文選題的價值意義和寫作的難點,同時也是本文力爭的創(chuàng)新之處。本文研究的基本內(nèi)容是:第一,實行負(fù)面清單管理模式的核心意義在于政府職能的調(diào)整和管理模式的變革,核心理念還在于處理好政府與市場的關(guān)系,市場經(jīng)濟(jì)的基本理論是實施負(fù)面清單模式的理論依據(jù)。第二,本文試圖從上海自貿(mào)區(qū)負(fù)面清單管理模式的誕生闡析對地方政府管理變革的挑戰(zhàn),說明負(fù)面清單從投資規(guī)則演變到管理的通用方法的內(nèi)在邏輯。梳理上海自貿(mào)區(qū)負(fù)面清單模式對地方政府管理的職能、模式、思維習(xí)慣等提出的挑戰(zhàn)及對地方政府提出的變革任務(wù)。第三,研究以負(fù)面清單管理模式引領(lǐng)地方政府管理變革路徑。本文認(rèn)為這個變革路徑主要包括:設(shè)置權(quán)力清單是對負(fù)面清單的支撐;有效的監(jiān)管是負(fù)面清單模式成功的關(guān)鍵;推行負(fù)面清單管理模式的制度基礎(chǔ)是信息機(jī)制建設(shè);社會組織是遞補(bǔ)簡政放權(quán)后公共管理空位的重要力量等。第四,推行單管理模式中地方政府變革的步驟與策略,這個過程應(yīng)該包括影響因素、變革時機(jī)、洞悉變革心理、分解變革步驟、消解變革阻力等。本文的研究方法是:通過閱讀分析國內(nèi)外文獻(xiàn)資料,思考負(fù)面清單模式與政府職能和管理模式變革的核心關(guān)聯(lián)和本質(zhì)所在;通過政策研究,分析把握全面深化改革的關(guān)鍵與政策措施,理解負(fù)面清單管理模式對于進(jìn)一步深化改革的意義;通過對一些地區(qū)和地方政府探索與實踐的實證分析,以及對相關(guān)調(diào)研報告的歸納整理,提煉推行負(fù)面清單模式的制度經(jīng)驗;通過理論與現(xiàn)實的綜合思考,對推行負(fù)面清單模式與地方政府管理變革所需要的理念、邏輯、方法、策略等進(jìn)行脈絡(luò)梳理和策略設(shè)計。本文的重要觀點是:政府具備什么樣的職能決定了其采用何種管理模式。負(fù)面清單模式實際上是一種政府管理變革,而研究地方政府管理變革的理論基礎(chǔ)是政府職能理論。縱攬政府職能理論的研究歷程,可以最為精要的概括為集中在關(guān)于政府、市場、社會三者關(guān)系演變之中。負(fù)面清單管理模式的原理非常簡單,但它是政府選擇管理模式的邏輯原點,推廣上海自貿(mào)區(qū)試點經(jīng)驗,就是要在全國推行負(fù)面清單、權(quán)力清單、責(zé)任清單,使各級政府通過行政管理權(quán)力的讓渡轉(zhuǎn)換成行政能力的提升,促進(jìn)地方政府管理模式從集權(quán)、控制、指令型向授權(quán)、規(guī)則、服務(wù)型轉(zhuǎn)變。本文的成果集中體現(xiàn)在系統(tǒng)研究負(fù)面清單模式下地方政府變革的過程和邏輯,研究實施這種變革的內(nèi)容與策略,筆者認(rèn)為如何設(shè)置權(quán)力清單和實施有效監(jiān)管、如何建設(shè)信息機(jī)制和社會組織關(guān)系到上海自貿(mào)區(qū)和我國未來經(jīng)濟(jì)社會發(fā)展的健康與否。如何把握推行清單管理模式中地方政府變革的步驟與策略,是對各地各級領(lǐng)導(dǎo)者的重要考驗。最后,筆者認(rèn)為:保持改革的方向不偏、動力不減,改革的頂層設(shè)計與基層探索有機(jī)聯(lián)動,培育一支擁有法治思維的公務(wù)員隊伍,是推行負(fù)面清單模式和地方政府管理變革的重要保障。
[Abstract]:Based on the negative inventory management mode of Shanghai Free Trade Area, this paper studies the path of the change of local government management mode. The theory of the operation principle of the negative list management mode is simple, but it has more shock and shock to the government and the public servant in terms of management mode, thinking habit and benefit adjustment. How to promote negative inventory model throughout the country is not only lack of theory theory, but also lack of ready-made practical experience. This is the task of the first trial of Shanghai Free Trade Zone. It is also the point of value and difficulty of writing in this paper. At the same time, it is also the innovation place in this paper. The basic content of this paper is as follows: Firstly, the core significance of implementing negative inventory management mode lies in the change of government function adjustment and management mode, and the core idea is to deal with the relationship between government and market, and the basic theory of market economy is the theoretical basis for the implementation of negative list mode. Secondly, this paper attempts to analyze the challenge of the change of local government management from the birth of negative inventory management mode in Shanghai Free Trade Zone, and explain the internal logic of the negative inventory from the investment rule to the general method of management. Combing the challenge of the negative inventory model of Shanghai Free Trade Area to local government management, such as the function, mode, thinking habit and so on, and the change task put forward by the local government. Thirdly, the research takes the negative inventory management model to lead the local government to manage the change path. This paper holds that this change path mainly includes: the establishment of the power list is the support to the negative inventory; the effective supervision is the key to the success of the negative inventory model; the system basis of the implementation of the negative inventory management mode is the construction of the information mechanism; Social organization is the important strength of public management vacancy after the right of administrative decentralization. Fourth, implement the steps and strategies of local government change in the single management mode, this process should include the influence factors, the change opportunity, the insight into the change psychology, the decomposition transformation step, dispel the change resistance and so on. The research methods of this paper are: reading and analyzing the literature at home and abroad, thinking about the core relationship and essence of the negative inventory model and the change of government function and management mode; through policy research, analyzing the key and policy measures of overall reform; Understanding the significance of negative inventory management mode for further deepening reform; through empirical analysis of the exploration and practice of some regions and local governments, and summarizing the relevant research reports, refining the system experience of carrying out negative listing model; adopting the comprehensive consideration of theory and reality; The concept, logic, method, strategy, etc. needed to carry out the negative inventory model and local government management change are analyzed and designed. The important point of this paper is: what kind of management mode is adopted by the government. The negative inventory model is actually a kind of government management change, and the theoretical basis of studying local government management change is the theory of government function. The research course of government's government function theory can be summarized as focusing on the relationship between government, market and society. The principle of the negative inventory management mode is very simple, but it is the logical origin of the government's choice of management mode, the promotion of the experience of the Shanghai Free Trade Zone, is to carry out the negative list, the power list and the responsibility list throughout the country. It transforms the governments at all levels through the transfer of administrative power to the promotion of administrative ability, and promotes the transformation of local government management mode from centralization, control and instruction type to authorization, rule and service. The results of this paper focus on the process and logic of the change of local government in the negative list mode of system research, study the content and strategy of implementing the change, the author thinks how to set up the power list and implement effective supervision, How to construct the information mechanism and social organization relation to the Shanghai Free Trade Zone and the future economic and social development of our country are healthy or not. How to grasp the steps and strategies of local government change in the list management mode is an important test for leaders at all levels. Finally, the author holds that the top-level design of the reform is not biased, the top-level design of the reform and the grass-roots exploration organic linkage, the cultivation of a civil servant with the rule of law thinking is an important guarantee to carry out the negative inventory model and the local government management change.
