行政法視野下的“行政三分制”改革

【摘要】:“行政三分制”是將行政權(quán)按照行政職能劃分為決策權(quán)、執(zhí)行權(quán)和監(jiān)督權(quán)的一種行政體制改革方案!靶姓种啤斌w現(xiàn)了憲法上的分權(quán)理論、人權(quán)保障理論,行政法上的控權(quán)理論、法治政府理論,行政管理學(xué)上的新公共管理論等。在實(shí)踐上也有英國(guó)執(zhí)行局化改革等成功的案例,日益成為當(dāng)前各國(guó)政治體制改革的新思路。深圳作為中國(guó)改革開放的試驗(yàn)田,其成功的實(shí)踐不僅在經(jīng)濟(jì)體制上為社會(huì)主義市場(chǎng)經(jīng)濟(jì)闖出了一套道路,如今又在試行“行政三分制”改革,意圖推動(dòng)中國(guó)政治體制改革。深圳市“行政三分制”改革取得了一定成果,但現(xiàn)行的“行政三分制”試點(diǎn)仍存在缺乏憲法層面支撐;未能完全實(shí)現(xiàn)行政權(quán)內(nèi)部的分立與制衡;保障公民權(quán)利、強(qiáng)化政府服務(wù)職能的制度安排不足等缺陷。欲完善行政三分制,不能僅將“行政三分制”看作是行政權(quán)的理性約束和自我限制,必須把這種改革方案放置于整個(gè)憲政體制改革的背景之下,完善憲法,明確注入國(guó)家機(jī)關(guān)分權(quán)制衡的憲政精神;進(jìn)一步深化落實(shí)決策、執(zhí)行和監(jiān)督權(quán)力運(yùn)行機(jī)制改革,推動(dòng)行政決策的科學(xué)化、民主化,,行政執(zhí)行的專業(yè)化、規(guī)范化,建立績(jī)效評(píng)估制度,落實(shí)行政問(wèn)責(zé)制,強(qiáng)化行政監(jiān)督;結(jié)合“行政三分制”,推動(dòng)公務(wù)員制度、政府機(jī)構(gòu)職能及其配置等配套機(jī)制的縱深發(fā)展。
[Abstract]:"Administrative trisection" is an administrative system reform scheme that divides administrative power into decision-making power, executive power and supervisory power according to administrative functions. The "administrative three-point system" embodies the theory of separation of powers in the constitution, the theory of human rights protection, the theory of controlling power in administrative law, the theory of government ruled by law, the theory of new public management in administrative management, and so on. In practice, there are also successful cases such as the reform of the British Executive Board, which has increasingly become a new way of political system reform in various countries. As an experimental field of China's reform and opening up, Shenzhen's successful practice not only blazed a set of paths for the socialist market economy in economic system, but also tried out the "administrative three-point system" reform, with the intention of pushing forward the reform of China's political system. Some achievements have been made in the reform of the "administrative three-point system" in Shenzhen, but the current "administrative three-point system" still lacks constitutional support, fails to fully realize the separation and checks and balances within the executive power, and guarantees the civil rights. Strengthen the system arrangement of government service function is insufficient and so on. In order to perfect the administrative three-point system, we should not only regard the "administrative three-point system" as the rational restriction and self-restriction of the executive power, we must put this reform scheme under the background of the whole constitutional system reform and perfect the constitution. To clearly inject the constitutional spirit of the separation of powers and checks and balances of state organs, to further deepen the implementation of decision-making, to implement and supervise the reform of the operating mechanism of power, to promote the scientific, democratic, specialized and standardized administrative decision-making, Establish the performance evaluation system, implement the administrative accountability system, strengthen the administrative supervision, and combine the "administrative three-point system" to promote the further development of the supporting mechanisms, such as the civil service system, the functions of government organs and their disposition.
