我國(guó)聘任制公務(wù)員考核制度研究

【摘要】:在新公共理論的影響下,從上世紀(jì)80年代開(kāi)始,西方資本主義國(guó)家陸續(xù)展開(kāi)了行政制度改革,許多國(guó)家的公務(wù)員制度也在這次改革中不斷完善。這些西方國(guó)家公務(wù)員制度改革的一個(gè)明確特點(diǎn)就是在公務(wù)員的選拔和任用上更加注重市場(chǎng)競(jìng)爭(zhēng)機(jī)制,許多合同雇傭制公務(wù)員和臨時(shí)性工作人員進(jìn)入到政府工作。這種聘任制公務(wù)員改革在西方國(guó)家不斷推進(jìn),帶來(lái)的優(yōu)勢(shì)也較為明顯,在有效降低政府成本的同時(shí),也改變了政府原有的低效狀態(tài)。聘任制公務(wù)員的出現(xiàn)和推廣都體現(xiàn)了對(duì)傳統(tǒng)政府管理的彈性化改革,而這種改革也對(duì)我國(guó)公務(wù)員制度的改革有一定的啟發(fā)。我國(guó)對(duì)于公務(wù)員制度的改革一直在嘗試和執(zhí)行,與之配套的各項(xiàng)制度也在不斷的完善中。2005年4月27日,全國(guó)人大常務(wù)委員會(huì)第十五次會(huì)議通過(guò)了《中華人民共和國(guó)公務(wù)員法》,該法于2006年1月1日起施行!吨腥A人民共和國(guó)公務(wù)員法》的一個(gè)亮點(diǎn)就是對(duì)聘任制公務(wù)員的法律地位進(jìn)行了確定,明確規(guī)定了聘任制公務(wù)員的適用范圍、聘任方式等具體內(nèi)容,這是我國(guó)公務(wù)員制度的重要改革。隨著市場(chǎng)經(jīng)濟(jì)的不斷發(fā)展,我國(guó)一些地方政府也開(kāi)始嘗試引入聘任制公務(wù)員,其中以廣東深圳和上海浦東最具有代表性。聘任制公務(wù)員作為“舶來(lái)品”,我國(guó)各地都在結(jié)合自身的實(shí)際進(jìn)行探索,形成了一定的特色和積累了一定的經(jīng)驗(yàn),但在探索的道路上也暴露出一些問(wèn)題。本文正是在這樣的背景下分析了當(dāng)前我國(guó)聘任制公務(wù)員發(fā)展過(guò)程中存在的問(wèn)題,并提出了具體的改革建議和完善措施。本文首先對(duì)公務(wù)員聘任制的背景和意義進(jìn)行了探討,通過(guò)文獻(xiàn)參考法,認(rèn)真分析了我國(guó)聘任制考核制度的現(xiàn)狀和當(dāng)前存在的問(wèn)題,并分析了我國(guó)當(dāng)前在聘任制公務(wù)員考核問(wèn)題上的原因,最后在借鑒了部分西方國(guó)家先進(jìn)經(jīng)驗(yàn)的基礎(chǔ)上,提出了我國(guó)公務(wù)員聘任制考核制度上的完善措施。
[Abstract]:Under the influence of the new public theory, since the 1980s, the western capitalist countries have carried out the administrative system reform one after another, and the civil service system of many countries has been continuously improved in this reform. A clear feature of civil service reform in these western countries is that they pay more attention to the market competition mechanism in the selection and appointment of civil servants. This kind of civil servant reform has been promoted in western countries and brought more obvious advantages. It can reduce the cost of the government and change the inefficient state of the government at the same time. The appearance and promotion of the appointment system of civil servants reflect the flexible reform of the traditional government management, and this kind of reform also has certain inspiration to the reform of the civil service system of our country. China's reform of the civil service system has been trying and implementing, and the matching system is also in the process of continuous improvement. April 27, 2005, The 15th meeting of the standing Committee of the National people's Congress adopted the Law of the people's Republic of China on Civil servants, which came into force on January 1, 2006. One of the highlights of the Law on Civil servants of the people's Republic of China is the appointment of civil servants. The legal status of the It is an important reform of the civil service system in our country that the specific contents such as the scope of application and the mode of appointment of civil servants are clearly stipulated. With the continuous development of the market economy, some local governments in our country have begun to try to introduce the appointment system of civil servants, among which Shenzhen in Guangdong and Pudong in Shanghai are the most representative. The appointment system of civil servants as "foreign goods", our country all in combination with their own reality to explore, formed a certain characteristics and accumulated certain experience, but in the way of exploration also exposed some problems. Under this background, this paper analyzes the problems existing in the process of the development of the employment system of civil servants in our country, and puts forward concrete reform suggestions and perfect measures. In this paper, the background and significance of the appointment system for civil servants are discussed, and the present situation and problems of the appointment system in China are analyzed through the method of literature reference. This paper also analyzes the reasons of the civil servants' appointment system in our country at present, and finally, on the basis of drawing lessons from the advanced experiences of some western countries, puts forward some measures to perfect the appraisal system of the appointment system of civil servants in our country.
