【摘要】:在給付行政領(lǐng)域,當行政機關(guān)委托第三方私人承擔給付行政任務(wù)時,需解決私人主體與受益人之間是私法關(guān)系抑或公法關(guān)系的難題。保障房租賃與買賣作為私人承擔給付行政的一種方式,為此難題的研究提供了絕佳的素材。保障房的租賃與買賣作為民事合同,可以一定程度實現(xiàn)公法上的給付目的,但也存在其局限性。我國公有租賃住房的產(chǎn)權(quán)功能和經(jīng)濟適用房的產(chǎn)權(quán)屬性是導(dǎo)致其局限性的重要原因。針對在我國特定情形下的保障房租賃和買賣關(guān)系,立法與司法應(yīng)建構(gòu)雙階法律關(guān)系,將其分為行政行為和合同兩個階段,以有效消除不正當使用保障房的行為,并保障受益人和其他潛在受益人合同締結(jié)的權(quán)利。
[Abstract]:In the administration, when administrative organs entrust the third party to pay private administrative tasks, between the subject and the beneficiary is the need to solve the problem of private or public law private relations. A way of low-income housing rental and sale as private pay administration, provides excellent materials for the study of this problem. The security leasing and sale housing as a civil contract, to a certain extent on the public law to achieve the purpose of payment, but it also has its limitations. Property rights of China's public rental housing and affordable housing property rights is an important reason to lead to the limitation. Aiming at the specific circumstances of China's low-income housing rental and sale, and legislation justice should construct double order legal relationship, which can be divided into two stages and administrative contract, to effectively eliminate the improper use of low-income housing behavior, and the protection of the beneficiaries and other potential The right of the beneficiary to conclude the contract.
