【摘要】：金融危機(jī)后,歐美監(jiān)管當(dāng)局針對證券市場"裸賣空"和"CDS裸賣空"制定了包括短期禁令在內(nèi)的各種新政策。這些新政使得相關(guān)問題再度引起熱議。本文針對這一熱點(diǎn),在理清賣空、證券市場裸賣空以及"CDS裸賣空"概念的基礎(chǔ)上,指出了"CDS裸賣空"與證券市場裸賣空在眾多方面存在的本質(zhì)性區(qū)別。與此同時(shí),文章對歐美監(jiān)管當(dāng)局關(guān)于賣空和裸賣空的監(jiān)管政策演變和最新動態(tài)進(jìn)行了簡要介紹。最后,文章還總結(jié)了歐美監(jiān)管當(dāng)局的相關(guān)新政對我國發(fā)展金融市場的啟示。
[Abstract]:In the wake of the financial crisis, regulators in Europe and the United States have adopted new policies, including short-term bans, against "naked short" and "CDS naked short" securities markets. These new policies have revived the debate on related issues. Aiming at this hot spot, on the basis of clarifying the concepts of short selling, naked short selling in securities market and CDS naked short selling, this paper points out the essential differences between naked short selling of CDS and naked short selling of securities market in many aspects. At the same time, the article briefly introduces the evolution and the latest development of the regulatory policies of the European and American regulatory authorities on short selling and naked short selling. Finally, the article summarizes the relevant new policies of the European and American regulatory authorities for the development of financial markets in China.
