J銀行S分行合規(guī)管理現(xiàn)狀分析與研究

【摘要】:近年來,國際國內(nèi)經(jīng)濟(jì)形勢日趨復(fù)雜,歐美國家自2008年遭受次貸危機(jī)以來尚未恢復(fù)元?dú)?歐州主權(quán)債務(wù)危機(jī)此起彼伏,在國內(nèi),我國銀行業(yè)金融機(jī)構(gòu)案件頻發(fā),各種違法違規(guī)和經(jīng)濟(jì)犯罪案件層出不窮,造成損失金額巨大,同時也嚴(yán)重影響了商業(yè)銀行的聲譽(yù)。加強(qiáng)合規(guī)管理是各大商業(yè)銀行穩(wěn)健發(fā)展的必然要求。目前,我國很多銀行業(yè)金融機(jī)構(gòu)已先后設(shè)立了合規(guī)管理部門,配備有專門的合規(guī)管理人員,構(gòu)建了合規(guī)風(fēng)險管理的初步框架,加強(qiáng)機(jī)構(gòu)自身的合規(guī)管理已成為了共識。但我國的合規(guī)風(fēng)險管理尚處于起步階段,以風(fēng)險為本的合規(guī)管理是一項(xiàng)復(fù)雜的系統(tǒng)工程,還面臨著一系列的問題和困難,做法和經(jīng)驗(yàn)還需要不斷積累和完善。 本文根據(jù)作者的長期工作實(shí)踐,在深入理解分析合規(guī)風(fēng)險管理相關(guān)理論、當(dāng)前國內(nèi)外商業(yè)銀行合規(guī)風(fēng)險管理體系的前提下,對J銀行S分行合規(guī)管理實(shí)際情況進(jìn)行了客觀評價,闡明了J銀行合規(guī)管理發(fā)展中存在的問題和原因,繼而對J銀行合規(guī)風(fēng)險管理體系構(gòu)建和實(shí)施提出了切實(shí)可行的改進(jìn)措施,包括強(qiáng)化合規(guī)管理組織架構(gòu)與職能職責(zé);以價值創(chuàng)造為導(dǎo)向深化合規(guī)管理內(nèi)涵;以電子化手段促進(jìn)合規(guī)執(zhí)行;以“風(fēng)險為本”強(qiáng)化合規(guī)監(jiān)督檢查;正確處理合規(guī)部與業(yè)務(wù)部門、風(fēng)險管理部、內(nèi)審部門的關(guān)系;持續(xù)開展合規(guī)宣傳教育,建設(shè)有特色的合規(guī)文化;加強(qiáng)合規(guī)人員隊伍建設(shè);加強(qiáng)合規(guī)人員績效考核機(jī)制。 本文主要分為六個部分。 第一章分析和論述了論文選題的背景和意義。 第二章通過對國內(nèi)外商業(yè)銀行合規(guī)管理發(fā)展歷程與現(xiàn)狀進(jìn)行分析,正確認(rèn)識和理解合規(guī)風(fēng)險、合規(guī)機(jī)構(gòu)及其職能。 第三章從指導(dǎo)思想和原則、合規(guī)管理流程、組織機(jī)構(gòu)設(shè)置、人員隊伍建設(shè)、合規(guī)風(fēng)險管理機(jī)制幾個方面分析和論述了S分行合規(guī)管理現(xiàn)狀。 第四、五、六章為文章的重點(diǎn)章節(jié),通過與國內(nèi)外銀行合規(guī)管理進(jìn)行對比分析,深入闡釋了S分行合規(guī)管理中存在的問題和原因,提出完善J銀行合規(guī)管理對策建議。 總之,本文主要就如何完善和優(yōu)化J銀行S分行合規(guī)風(fēng)險管理體系進(jìn)行了嘗試性的分析,目的是能夠?qū)⑶叭搜芯砍晒蚃銀行合規(guī)管理發(fā)展現(xiàn)狀有機(jī)結(jié)合起來。但是鑒于自身知識的淺薄和工作經(jīng)驗(yàn)的欠缺,文中肯定存在許多的不足和片面之處,敬請專家學(xué)者們給予批評指正,本人將在以后的工作中繼續(xù)學(xué)習(xí)、繼續(xù)探索。謝謝各位評審老師和答辯老師!
[Abstract]:In recent years, the international and domestic economic situation is becoming more and more complex, the European and American countries have not recovered since the subprime mortgage crisis in 2008, and the sovereign debt crisis in Europe has been one after another.A variety of illegal and economic crimes emerge in endlessly, resulting in huge losses, but also seriously affected the reputation of commercial banks.Strengthening compliance management is an inevitable requirement for the steady development of major commercial banks.At present, many banking financial institutions in China have established compliance management departments, equipped with special compliance managers, constructed a preliminary framework of compliance risk management, and strengthened compliance management of institutions themselves has become a consensus.But the compliance risk management of our country is still in the initial stage, the compliance management based on the risk is a complex system engineering, it also faces a series of problems and difficulties, and the practice and experience still need to be accumulated and perfected.Based on the author's long term work practice, this paper makes an objective evaluation on the compliance management of J Bank S Branch on the premise of deeply understanding and analyzing the compliance risk management theory and the current compliance risk management system of commercial banks at home and abroad.This paper expounds the problems and reasons existing in the development of J bank compliance management, and then puts forward some practical improvement measures for the construction and implementation of J bank compliance risk management system, including strengthening the organizational structure and functional responsibilities of compliance management.Deepening the connotation of compliance management guided by value creation; promoting compliance implementation by electronic means; strengthening compliance supervision and inspection with "risk as the basis"; correctly handling the relationship between compliance department and business department, risk management department, internal audit department;We should continuously carry out compliance propaganda and education, build a characteristic compliance culture, strengthen the construction of compliance personnel, and strengthen the performance appraisal mechanism of compliance personnel.This paper is divided into six parts.The first chapter analyzes and discusses the background and significance of the thesis.The second chapter analyzes the development history and present situation of compliance management of commercial banks at home and abroad, and correctly understands compliance risks, compliance institutions and their functions.The third chapter analyzes and discusses the status quo of compliance management in S branch from the aspects of guiding ideology and principle, compliance management process, organization setting, personnel construction and compliance risk management mechanism.The fourth, fifth and sixth chapters are the key chapters of the article. Through the comparative analysis with the domestic and foreign bank compliance management, the paper deeply explains the problems and reasons in S branch compliance management, and puts forward some suggestions to perfect J bank compliance management.In a word, this paper mainly analyzes how to perfect and optimize the compliance risk management system of J Bank S Branch. The purpose of this paper is to combine the previous research results with the development of J Bank compliance management.However, in view of their shallow knowledge and lack of work experience, there must be many shortcomings and one-sided points in this paper.
