銀行監(jiān)管國(guó)際協(xié)調(diào)與合作研究

【摘要】:在金融全球化背景下,跨境銀行迅速發(fā)展,系統(tǒng)性風(fēng)險(xiǎn)顯現(xiàn),金融危機(jī)跨境傳播明顯,對(duì)銀行監(jiān)管的國(guó)際協(xié)調(diào)與合作提出了現(xiàn)實(shí)需要。國(guó)際組織(如巴塞爾委員會(huì))在銀行監(jiān)管的國(guó)際協(xié)調(diào)與合作中發(fā)揮了重要作用。本文主要研究了各國(guó)銀行監(jiān)管者在巴塞爾委員會(huì)等國(guó)際組織制定的原則指導(dǎo)下進(jìn)行的銀行監(jiān)管國(guó)際協(xié)調(diào)與合作,包括協(xié)調(diào)與合作的背景、機(jī)制、內(nèi)容和效果,在總結(jié)國(guó)際經(jīng)驗(yàn)的基礎(chǔ)上提出了我國(guó)參與銀行監(jiān)管國(guó)際協(xié)調(diào)與合作的對(duì)策。 金融全球化是銀行監(jiān)管國(guó)際協(xié)調(diào)與合作的背景。自上個(gè)世紀(jì)八十年代以來(lái),金融自由化浪潮興起,促進(jìn)了金融全球化的發(fā)展,帶來(lái)資本大規(guī)?缇沉鲃(dòng)。一方面金融全球化促進(jìn)了經(jīng)濟(jì)發(fā)展,另一方面金融危機(jī)頻繁發(fā)生。近年來(lái),金融系統(tǒng)的系統(tǒng)性風(fēng)險(xiǎn)顯現(xiàn),表現(xiàn)在:在多種外部監(jiān)管規(guī)則的作用下,銀行經(jīng)營(yíng)的順周期性明顯(時(shí)間維度的系統(tǒng)性風(fēng)險(xiǎn)),同時(shí),,資產(chǎn)證券化使風(fēng)險(xiǎn)分散在眾多市場(chǎng)參與者手中,但整個(gè)金融系統(tǒng)的脆弱性增加(跨部門維度的系統(tǒng)性風(fēng)險(xiǎn))。 本文研究的銀行監(jiān)管國(guó)際協(xié)調(diào)與合作是各國(guó)銀行監(jiān)管當(dāng)局在巴塞爾委員會(huì)等國(guó)際組織的指導(dǎo)和組織下,依據(jù)國(guó)際組織制定的國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則進(jìn)行的。從歷史上看,銀行破產(chǎn)或金融危機(jī)是推動(dòng)銀行監(jiān)管國(guó)際協(xié)調(diào)與合作不斷發(fā)展的力量,如Herstantt銀行倒閉推動(dòng)了巴塞爾委員會(huì)的建立,BCCI銀行的倒閉推動(dòng)了跨境銀行監(jiān)管原則的建立,亞洲金融危機(jī)推動(dòng)了一系列金融監(jiān)管國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的建立。國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的制定通常是由發(fā)達(dá)國(guó)家提議,巴塞爾委員會(huì)等國(guó)際組織制定方案并組織各成員國(guó)討論通過,然后由各成員國(guó)在本國(guó)監(jiān)管法規(guī)中落實(shí)執(zhí)行。廣大發(fā)展中國(guó)家雖然并沒有參與國(guó)際標(biāo)準(zhǔn)和規(guī)則的制定,但為了獲得國(guó)際金融市場(chǎng)的認(rèn)可,往往也參與到對(duì)監(jiān)管國(guó)際標(biāo)準(zhǔn)和規(guī)則的執(zhí)行中來(lái)。 本文從跨境銀行監(jiān)管和各國(guó)對(duì)監(jiān)管國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的執(zhí)行等兩個(gè)方面對(duì)銀行監(jiān)管國(guó)際協(xié)調(diào)與合作的內(nèi)容進(jìn)行分析?缇炽y行的監(jiān)管是母國(guó)和東道國(guó)銀行監(jiān)管者進(jìn)行監(jiān)管協(xié)調(diào)與合作的主要內(nèi)容。依據(jù)巴塞爾委員會(huì)制定的并表監(jiān)管原則,本文從日常監(jiān)管中的國(guó)際協(xié)調(diào)與合作、金融危機(jī)中的國(guó)際協(xié)調(diào)與合作、宏觀審慎監(jiān)管中的國(guó)際協(xié)調(diào)與合作等三個(gè)方面對(duì)母國(guó)和東道國(guó)監(jiān)管者之間的協(xié)調(diào)與配合進(jìn)行了分析。各國(guó)銀行監(jiān)管者對(duì)銀行監(jiān)管國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的執(zhí)行是各國(guó)為加強(qiáng)金融基礎(chǔ)設(shè)施而進(jìn)行的監(jiān)管國(guó)際協(xié)調(diào)與合作。在監(jiān)管國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的推廣方面,國(guó)際組織通過對(duì)各國(guó)遵守國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的程度進(jìn)行評(píng)估和技術(shù)援助,在推廣國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的過程中發(fā)揮了重要作用。此外,市場(chǎng)力量和跨境銀行的發(fā)展也推動(dòng)了監(jiān)管國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則在各國(guó)的執(zhí)行。學(xué)術(shù)界對(duì)執(zhí)行《有效銀行監(jiān)管核心原則》和《新資本協(xié)議》等國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的效果進(jìn)行了大量實(shí)證研究,研究發(fā)現(xiàn):執(zhí)行監(jiān)管國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則有助于金融基礎(chǔ)設(shè)施的完善和銀行風(fēng)險(xiǎn)管理水平的提高,但并不能阻止金融危機(jī)的發(fā)生,執(zhí)行銀行監(jiān)管國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則是金融穩(wěn)定的必要條件而不是充分條件。執(zhí)行銀行監(jiān)管國(guó)際標(biāo)準(zhǔn)對(duì)宏觀經(jīng)濟(jì)具有一定影響,如《新資本協(xié)議》的順周期性等。 本文在最后一章對(duì)我國(guó)參與銀行監(jiān)管國(guó)際協(xié)調(diào)與合作的對(duì)策進(jìn)行了分析,包括資本監(jiān)管原則的落實(shí)、宏觀審慎監(jiān)管工具和治理結(jié)構(gòu)、跨境銀行監(jiān)管國(guó)際協(xié)調(diào)與合作等三個(gè)方面。 本文在寫作過程中參閱了大量最新的國(guó)外研究文獻(xiàn),以巴塞爾委員會(huì)指導(dǎo)下的銀行監(jiān)管國(guó)際協(xié)調(diào)與合作為主線,系統(tǒng)、全面地梳理了銀行監(jiān)管國(guó)際協(xié)調(diào)與合作的背景、發(fā)展過程、形成機(jī)制和內(nèi)容,分析了2008年美國(guó)金融危機(jī)以來(lái)對(duì)跨境銀行微觀審慎監(jiān)管和宏觀審慎監(jiān)管國(guó)際協(xié)調(diào)與合作的國(guó)際經(jīng)驗(yàn)和做法,對(duì)國(guó)外學(xué)者在金融監(jiān)管國(guó)際標(biāo)準(zhǔn)和準(zhǔn)則的作用和效果方面進(jìn)行的大量理論和實(shí)證研究進(jìn)行了整理和總結(jié)。在借鑒國(guó)際經(jīng)驗(yàn)的基礎(chǔ)上,提出了我國(guó)參與銀行監(jiān)管國(guó)際協(xié)調(diào)與合作的對(duì)策,具有重要的現(xiàn)實(shí)意義。本文的不足之處在于沒有建立銀行監(jiān)管國(guó)際協(xié)調(diào)與合作的理論分析框架。
[Abstract]:Under the background of financial globalization, the rapid development of cross-border banks, systemic risk appears, cross-border financial crisis communication, international coordination and cooperation in banking supervision put forward the realistic need. International organizations (such as the Basel Committee) played an important role in the international coordination and cooperation in banking supervision. This paper mainly studies the national bank regulators the guiding principle in international organizations such as the Basel Committee for banking supervision under the international coordination and cooperation, including cooperation and coordination mechanism, background, content and effect, based on summarizing the international experience and puts forward some countermeasures for China's participation in international coordination and cooperation in banking supervision.
Financial globalization is the international coordination and cooperation in banking supervision background. Since the last century since 80s, the rise of the tide of financial liberalization, and promote the development of financial globalization, capital flow. A large-scale cross-border financial globalization promotes economic development, on the other hand, the financial crisis occurred frequently. In recent years, systemic risk in the financial system appeared in a variety of external regulatory rules under the effect of bank procyclicality significantly (systemic risk time dimension), at the same time, the asset securitization risk dispersed in many market participants hands, but the fragility of the financial system as a whole (increased systemic risk of cross sectoral dimension).
This paper studies the banking supervision of international coordination and cooperation is the supervisory authorities of each country in international organizations such as the Basel Committee's guidance and organization, on the basis of international organizations to develop international standards and criteria. Historically, bank insolvency or financial crisis is to promote international coordination and cooperation in banking supervision development strength, such as Herstantt bank the collapse of promoting the establishment of a Basel Committee, BCCI bank failures led to the creation of the principle of cross-border banking supervision, the Asian financial crisis to promote the establishment of a series of international financial regulatory standards and guidelines. The formulation of international standards and norms are usually proposed by developed countries and international organizations to develop programs such as the Basel Committee and discussion group members by then, by the member states in the country in the implementation of regulations. Although the vast developing countries did not participate in the international standard. In order to obtain the recognition of the international financial market, it is often involved in the implementation of the international standards and rules of supervision.
This paper carries on the analysis from the cross-border banking supervision and other two aspects of the supervision of international standards and guidelines for the implementation of international coordination and cooperation in banking supervision. The content of cross-border banking supervision is the main content of host country and bank regulators for regulatory coordination and cooperation. On the basis of the Basel Committee formulated the principle of consolidated supervision, the international coordination and cooperation from the daily supervision, international coordination and cooperation in the financial crisis, the three aspects of macro prudential supervision in the international coordination and cooperation for the analysis of the coordination and cooperation between home and host supervisors. Banks regulators on international standards for banking supervision and implementation of the guidelines is the supervision of countries to strengthen international coordination and cooperation the financial infrastructure and the promotion. In the supervision of international standards and norms, through international organizations of States to comply with international standard Standard and criterion to assess the extent and technical assistance, played an important role in the promotion of international standards and norms. In addition, the development of market forces and cross-border banks also contributed to the regulation of international standards and norms in national execution. Academia on the implementation of < > effective banking supervision and the core principles of "new capital agreement > and other international standards and guidelines for a large number of empirical studies, the study found that: the supervision of the implementation of international standards and norms and improve the level of bank risk management is helpful to improve the financial infrastructure, but can not stop the financial crisis occurred, the implementation of standards and norms of international banking supervision is necessary but not sufficient condition for financial stability implementation of international standards for banking supervision. It has certain effect on the macro economy, such as the" new capital agreement > procyclicality.
In the last chapter, this paper analyzes the Countermeasures of China's participation in banking supervision and international coordination and cooperation, including the implementation of capital regulation principles, macro prudential regulatory tools and governance structure, cross-border banking supervision, international coordination and cooperation and so on three aspects.
This paper refers to a large number of the latest foreign literature in the process of writing, the Basel Committee on Banking Supervision under the guidance of international coordination and cooperation as the main line, system, comprehensive sort of international coordination and cooperation in banking supervision in the background, development process, formation mechanism and content analysis, since the 2008 financial crisis in the United States on cross-border banking prudential supervision and macro prudential supervision of international coordination and cooperation of the international experience and practice, a lot of theoretical and empirical aspects of the role of foreign scholars in the international standard of financial supervision and standards and the effect of the research are summarized. Based on the international experience, and puts forward some countermeasures for China's participation in international coordination and cooperation in banking regulation, has the important practical significance. The shortage of this article is not the establishment of international coordination and cooperation in banking supervision in the framework of theoretical analysis.
