【摘要】：隨著科學(xué)技術(shù)的發(fā)展,信息化浪潮在全世界興起,信息資源通過(guò)互聯(lián)網(wǎng)得到廣泛的傳播,對(duì)世界范圍內(nèi)的政治、文化、經(jīng)濟(jì)、法律等各個(gè)方面都產(chǎn)生了巨大的影響。但與此同時(shí),這些共享信息的知識(shí)產(chǎn)權(quán)保護(hù)問題也凸顯出來(lái),成為亟待解決的一個(gè)難題。網(wǎng)絡(luò)共享與知識(shí)產(chǎn)權(quán)保護(hù)的關(guān)系是辯證統(tǒng)一的,既有相互矛盾的地方,又在一定程度上相互統(tǒng)一。 本文通過(guò)對(duì)互聯(lián)網(wǎng)信息應(yīng)用的發(fā)展趨勢(shì)的預(yù)測(cè),判斷在當(dāng)前和今后一段時(shí)間內(nèi),信息網(wǎng)絡(luò)共享將極大地便利,必將徹底地影響人類的工作和生活。與此同時(shí),信息網(wǎng)絡(luò)共享又必然增大網(wǎng)絡(luò)侵犯知識(shí)產(chǎn)權(quán)的行為,加大知識(shí)產(chǎn)權(quán)保護(hù)的難度。通過(guò)概括總結(jié)網(wǎng)絡(luò)知識(shí)產(chǎn)權(quán)和網(wǎng)絡(luò)環(huán)境下信息資源共享的特點(diǎn),深入分析了網(wǎng)絡(luò)共享與知識(shí)產(chǎn)權(quán)保護(hù)之間相互矛盾又統(tǒng)一的關(guān)系。 在當(dāng)前的網(wǎng)絡(luò)環(huán)境下,知識(shí)產(chǎn)權(quán)存在的侵權(quán)問題主要表現(xiàn)在,網(wǎng)絡(luò)共享引發(fā)的著作權(quán)問題、域名與商標(biāo)權(quán)的沖突問題、侵犯專利權(quán)的問題以及網(wǎng)絡(luò)引發(fā)的數(shù)據(jù)庫(kù)保護(hù)、合理使用等新的問題。通過(guò)對(duì)這些存在問題原因的分析,認(rèn)為要解決網(wǎng)絡(luò)共享與知識(shí)產(chǎn)權(quán)保護(hù)的利益沖突,關(guān)鍵就是要尋求一個(gè)平衡,平衡兩者的權(quán)益。具體來(lái)說(shuō)涉及到三方的利益,分別是知識(shí)產(chǎn)權(quán)權(quán)利人、公眾網(wǎng)絡(luò)用戶、網(wǎng)絡(luò)服務(wù)商。立足中國(guó)國(guó)情,政府要加強(qiáng)對(duì)知識(shí)產(chǎn)權(quán)權(quán)利人的保護(hù),從立法、司法、行政等各個(gè)層面綜合推進(jìn),爭(zhēng)取在網(wǎng)絡(luò)知識(shí)產(chǎn)權(quán)立法上有所突破；主導(dǎo)建立成熟有序的網(wǎng)絡(luò)資源共享平臺(tái)；積極參與國(guó)際合作,推動(dòng)國(guó)家間侵權(quán)標(biāo)準(zhǔn)的統(tǒng)一。同時(shí),約束、規(guī)范和引導(dǎo)公眾網(wǎng)絡(luò)用戶合理使用,嚴(yán)格執(zhí)行法定許可,加大對(duì)公眾網(wǎng)絡(luò)用戶關(guān)于知識(shí)產(chǎn)權(quán)的宣傳教育。對(duì)網(wǎng)絡(luò)服務(wù)商,督促其合理使用“避風(fēng)港原則”。 中國(guó)網(wǎng)民上網(wǎng)的“原始沖動(dòng)”很大部分來(lái)自于網(wǎng)絡(luò)上大量的免費(fèi)信息和資源,雖然我國(guó)的互聯(lián)網(wǎng)信息產(chǎn)業(yè)得到了飛速的發(fā)展,但這種發(fā)展不應(yīng)該以犧牲權(quán)利人的知識(shí)產(chǎn)權(quán)為代價(jià)。怎樣促進(jìn)兩者同步發(fā)展,關(guān)鍵就是尋求一個(gè)平衡。衷心希望,我國(guó)的網(wǎng)絡(luò)共享能更加有序地進(jìn)行,在范圍和影響力上都有所擴(kuò)大,而同時(shí)我國(guó)的知識(shí)產(chǎn)權(quán)保護(hù)事業(yè)也能蓬勃發(fā)展。
[Abstract]:With the development of science and technology, the tide of information is rising all over the world, and the information resources are widely spread through the Internet, which has a great influence on the political, cultural, economic, legal and other aspects of the world. But at the same time, these shared information intellectual property protection problems also highlighted, become an urgent problem. The relationship between network sharing and intellectual property protection is dialectical and unified. Based on the prediction of the development trend of Internet information application, this paper judges that the information network sharing will be greatly convenient at present and in the future, and will definitely affect the work and life of human beings thoroughly. At the same time, information network sharing is bound to increase the network infringement of intellectual property rights and increase the difficulty of intellectual property protection. By summing up the characteristics of network intellectual property and information resource sharing under network environment, this paper deeply analyzes the contradictory and unified relationship between network sharing and intellectual property protection. In the current network environment, the infringement of intellectual property rights is mainly manifested in the copyright problem caused by network sharing, the conflict between domain name and trademark right, the infringement of patent right and the database protection caused by network. New problems such as rational use. Through the analysis of the causes of these problems, it is considered that the key to solve the conflict between network sharing and intellectual property protection is to seek a balance and balance the rights and interests of both. Specifically, it involves the interests of the three parties, namely, intellectual property rights holders, public network users and network service providers. Based on China's national conditions, the government should strengthen the protection of intellectual property rights holders, from the legislative, judicial, administrative and other levels of comprehensive promotion, strive for a breakthrough in network intellectual property legislation; Leading the establishment of a mature and orderly network resource sharing platform, actively participating in international cooperation, promoting the unification of tort standards between countries. At the same time, we should restrict, standardize and guide the rational use of public network users, strictly enforce the legal permission, and increase the publicity and education of public network users on intellectual property rights. To network service provider, urge them to use "safe haven principle" rationally. Most of the "primitive impulses" of Chinese Internet users come from a large amount of free information and resources on the Internet, although China's Internet information industry has developed rapidly. However, this development should not be at the expense of the intellectual property rights of the right holder. How to promote the simultaneous development of the two, the key is to find a balance. It is hoped that the network sharing in China will be carried out more orderly, and its scope and influence will be expanded, and at the same time, the protection of intellectual property rights in China will flourish.
