【摘要】：我國近些年隨著社會經(jīng)濟的不斷發(fā)展,海外投資合作的規(guī)模和領(lǐng)域得以迅速擴大,越來越多的中國企業(yè)開始逐步到國際舞臺開辟各自的海外市場。然而正當這些企業(yè)興致沖沖地在海外市場闖蕩的同時,卻屢遭外國企業(yè)或個人的知識產(chǎn)權(quán)訴訟,這不僅影響了企業(yè)的海外市場,更會抹黑企業(yè)的國際聲譽,阻礙中國經(jīng)濟的發(fā)展。反思其中存在的問題：企業(yè)在海外知識產(chǎn)權(quán)維權(quán)方面的態(tài)度怠慢,且海外知識產(chǎn)權(quán)管理意識較差；政府部門呈現(xiàn)相關(guān)立法層面的缺失,并且在執(zhí)法力度和預(yù)警方面也有所欠缺；對于行業(yè)協(xié)會在海外知識產(chǎn)權(quán)保護方面的作用,當前也沒有能夠予以充分發(fā)揮和利用。目前,在我國海外投資流向較多的發(fā)達國家中,以美國和歐盟的知識產(chǎn)權(quán)保護最具代表性。其中美國的相關(guān)法律規(guī)定和救濟體系非常齊全,并且處罰標準高、侵權(quán)代價大；而歐盟的知識產(chǎn)權(quán)法律體系是由歐盟和成員國兩個層面組成,相關(guān)執(zhí)法標準也十分嚴格。此外,我國現(xiàn)階段海外投資主要流向發(fā)展中國家,其中對東盟投資總量較大,且發(fā)展迅速。然而東盟成員國中大多數(shù)國家還處d 經(jīng)濟發(fā)展初步階段,知識產(chǎn)權(quán)法律制度相對比較欠缺,同時東盟知識產(chǎn)權(quán)法律一體化的難度較大,而各成員國間的規(guī)定也有所差異。放眼國際層面,知識產(chǎn)權(quán)國際保護制度也正經(jīng)歷大的考驗。以ACTA、TPP、 TTIP等多邊協(xié)議談判為代表,知識產(chǎn)權(quán)國際保護的發(fā)展正呈現(xiàn)出：發(fā)達國家主導的強強聯(lián)合、傾向多邊區(qū)域性談判、偏重知識產(chǎn)權(quán)執(zhí)法、重視網(wǎng)絡(luò)侵權(quán)處理等趨勢。這些全新的多邊知識產(chǎn)權(quán)規(guī)則很可能會弱化現(xiàn)有WTO、WIPO等國際知識產(chǎn)權(quán)保護制度,包括中國在內(nèi)的新興經(jīng)濟體國家從現(xiàn)有法律制度中所獲的利益也將受到極大的影響,對于我國的海外投資也可能會形成無可估量的負面作用。但若樂觀地看待,這些新的變革也能使我國重新審視國內(nèi)相關(guān)法律制度,并從中研究對策、尋找機遇。面對這些現(xiàn)實緊迫的問題,如何予以應(yīng)對規(guī)范,成為我國海外投資中知識產(chǎn)權(quán)法律保護制度改善的重中之重。因此,有必要對我國目前海外投資中知識產(chǎn)權(quán)保護方面所呈現(xiàn)出的問題進行研究,并結(jié)合我國海外投資主要流向國的知識產(chǎn)權(quán)法律制度和國際知識產(chǎn)權(quán)法律制度,以期嘗試從政府、企業(yè)、行業(yè)協(xié)會三個層面分別找出其中的一些完善建議,從而為我國海外投資的發(fā)展進程保駕護航。
[Abstract]:In recent years, with the development of social economy, the scale and field of overseas investment cooperation has been expanded rapidly. More and more Chinese enterprises are beginning to open up their own overseas markets on the international stage. However, while they are making a dash in overseas markets, they are repeatedly sued by foreign enterprises or individuals in intellectual property rights. This not only affects the overseas market of enterprises, but also tarnishes the international reputation of enterprises and impedes the development of China's economy. And overseas intellectual property management awareness is poor; government departments show the lack of relevant legislation, and in law enforcement and early warning are also lacking; for the role of industry associations in overseas intellectual property protection, At present, we have not been able to give full play to and make full use of it. At present, among the developed countries where China's overseas investment flows to a large extent, The protection of intellectual property rights in the United States and the European Union is the most representative. Among them, the relevant legal provisions and relief system of the United States are very complete, and the standard of punishment is high, and the cost of infringement is high. The intellectual property legal system of the EU is composed of two levels, the EU and its member states, and the relevant enforcement standards are also very strict. In addition, at this stage, China's overseas investment mainly flows to developing countries, among which the total amount of investment in ASEAN is relatively large. And it is developing rapidly. However, most of the ASEAN member countries are still in the initial stage of economic development, and the legal system of intellectual property rights is relatively lacking. At the same time, the integration of intellectual property laws in ASEAN is more difficult. At the international level, the international protection of intellectual property rights is also undergoing a great test. As represented by the negotiations on multilateral agreements, such as ACTAT TPP, TTIP and so on, The development of the international protection of intellectual property rights is showing: strong and strong alliances led by developed countries tend to multilateral regional negotiations, and emphasis is placed on intellectual property law enforcement. Attach importance to the trend of network infringement treatment. These new multilateral intellectual property rules are likely to weaken the existing international intellectual property protection system such as WTOO / WIPO. The benefits of the existing legal system for emerging economies, including China, will also be greatly affected and may have an incalculable negative impact on China's overseas investment. But if we look at it optimistically, These new changes can also enable our country to re-examine the relevant domestic legal system, and to study the countermeasures, to find opportunities. In the face of these urgent practical problems, how to deal with the norms, Therefore, it is necessary to study the problems of intellectual property protection in overseas investment. Combined with the intellectual property legal system and the international intellectual property legal system of China's overseas investment, this paper tries to find out some perfect suggestions from three aspects of government, enterprise and trade association respectively. In order to protect the development process of overseas investment in China.
