【摘要】：職務(wù)發(fā)明是知識產(chǎn)權(quán)法的重要內(nèi)容,職務(wù)發(fā)明的權(quán)利歸屬問題是專利法律保護關(guān)系中最為關(guān)注的問題,對保護發(fā)明者的創(chuàng)新積極性有重要作用。本文試圖從職務(wù)發(fā)明的概念分析入手,分析我國職務(wù)發(fā)明判斷標準的局限性,借鑒國外先進經(jīng)驗,對職務(wù)發(fā)明的權(quán)利歸屬問題做如下探討:職務(wù)發(fā)明應充分重視職務(wù)發(fā)明人的重要作用,為職務(wù)發(fā)明人提供有力的法律保護保障制度和合理報酬及獎勵,鼓勵發(fā)明人的創(chuàng)造熱情。
[Abstract]:Job invention is an important part of intellectual property law, and the ownership of the right of duty invention is the most concerned issue in the legal protection of patent. This paper tries to analyze the limitation of the judgment standard of the duty invention in our country, draw lessons from the advanced experience of foreign countries, and try to analyze the limitation of the judgment standard of the duty invention from the concept analysis of the duty invention. This paper probes into the ownership of the right of the job invention as follows: the duty invention should pay full attention to the important role of the job inventor, provide the powerful legal protection system, reasonable remuneration and reward for the duty inventor, and encourage the inventor's creative enthusiasm.
