【摘要】：知識(shí)產(chǎn)權(quán)作為知識(shí)經(jīng)濟(jì)時(shí)代最核心的戰(zhàn)略資源，已經(jīng)成為當(dāng)今各國(guó)推動(dòng)經(jīng)濟(jì)發(fā)展、社會(huì)進(jìn)步最重要的國(guó)家戰(zhàn)略之一。隨著我國(guó)市場(chǎng)經(jīng)濟(jì)和對(duì)外開放步伐的加快，涉外與國(guó)內(nèi)知識(shí)產(chǎn)權(quán)貿(mào)易量不斷攀升。因此，健全我國(guó)知識(shí)產(chǎn)權(quán)保護(hù)制度，規(guī)范知識(shí)產(chǎn)權(quán)交易行為，對(duì)于我國(guó)經(jīng)濟(jì)的健康發(fā)展、推動(dòng)自主創(chuàng)新和科技進(jìn)步，顯得十分重要而迫切。海關(guān)在進(jìn)出境環(huán)節(jié)對(duì)保護(hù)知識(shí)產(chǎn)權(quán)的重要性不言而喻，健全知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度、切實(shí)維護(hù)知識(shí)產(chǎn)權(quán)權(quán)利人、進(jìn)出口收發(fā)貨人與社會(huì)公眾之間的利益平衡，應(yīng)當(dāng)成為健全我國(guó)知識(shí)產(chǎn)權(quán)保護(hù)制度的題中應(yīng)有之義。在當(dāng)今激烈的國(guó)際貿(mào)易競(jìng)爭(zhēng)中，權(quán)利濫用的現(xiàn)象層出不窮，知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)被越來(lái)越多地當(dāng)作搶占市場(chǎng)、打擊對(duì)手、獲取壟斷利潤(rùn)的工具，，嚴(yán)重破壞了利益平衡，違背了保護(hù)知識(shí)產(chǎn)權(quán)的初衷和目的。鑒于此，有必要進(jìn)一步完善知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度，從立法層面有效規(guī)制權(quán)利濫用行為、理順知識(shí)產(chǎn)權(quán)利益關(guān)系，從而維護(hù)知識(shí)產(chǎn)權(quán)與公眾利益的平衡，使知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度回歸本位，實(shí)現(xiàn)保護(hù)、和規(guī)制的有機(jī)統(tǒng)一。 本文重點(diǎn)梳理了國(guó)際（主要以TRIPS協(xié)議為依據(jù)）和國(guó)內(nèi)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度中禁止權(quán)利濫用的有關(guān)規(guī)定，進(jìn)而從知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)的備案、申請(qǐng)、扣留、調(diào)查等若干環(huán)節(jié)入手，結(jié)合權(quán)利濫用的相關(guān)理論和知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)實(shí)踐，分析了權(quán)利濫用的主要表現(xiàn)形式及其影響，并從實(shí)體法和程序法兩個(gè)層面，深入研究了權(quán)利濫用現(xiàn)象背后折射出我國(guó)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度存在的問題，最后據(jù)此從立法和執(zhí)法兩個(gè)方面提出了完善我國(guó)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度、規(guī)制權(quán)利濫用行為的對(duì)策建議。 本文共分6個(gè)部分：第一章為緒論，重點(diǎn)闡述研究目的和意義，梳理國(guó)內(nèi)外研究現(xiàn)狀，提出研究設(shè)想、方法、內(nèi)容和結(jié)構(gòu)；第二章為知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)的基本理論，簡(jiǎn)要論述我國(guó)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)的基本概念、淵源，知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度建立和發(fā)展等基本情況，在此基礎(chǔ)上，重點(diǎn)分析了“禁止權(quán)利濫用”這一民法基本原則在知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度中的體現(xiàn)，即現(xiàn)行制度中規(guī)制權(quán)利濫用的有關(guān)規(guī)定；第三章為知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)中權(quán)利濫用的現(xiàn)象分析，從知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)的備案、申請(qǐng)、扣留、調(diào)查等環(huán)節(jié)，結(jié)合權(quán)利濫用的基本理論、海關(guān)保護(hù)程序法的相關(guān)規(guī)定以及海關(guān)執(zhí)法實(shí)踐，對(duì)權(quán)利濫用的具體表現(xiàn)進(jìn)行深入剖析，并在此基礎(chǔ)上，闡述了權(quán)利濫用行為對(duì)權(quán)利人和進(jìn)出口收發(fā)貨人、海關(guān)以及公眾等利益相關(guān)者的影響；第四章為我國(guó)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)權(quán)利濫用的原因分析，從實(shí)體法和程序法兩個(gè)層面，結(jié)合全球知識(shí)產(chǎn)權(quán)保護(hù)的發(fā)展趨勢(shì)和形勢(shì)變化，以及我國(guó)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度建立和發(fā)展的歷史和現(xiàn)實(shí)因素，深入分析權(quán)利濫用產(chǎn)生的深層次法律原因，由此揭示我國(guó)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度存在的問題，主要表現(xiàn)在立法傾向、知識(shí)產(chǎn)權(quán)保護(hù)的模式、機(jī)制以及執(zhí)法程序等方面；第五章為我國(guó)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)中規(guī)制權(quán)利濫用的對(duì)策建議，結(jié)合我國(guó)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)的實(shí)際，從完善立法和改進(jìn)執(zhí)法兩個(gè)方面提出規(guī)制權(quán)利濫用的對(duì)策建議，強(qiáng)調(diào)知識(shí)產(chǎn)權(quán)海關(guān)保護(hù)制度的完善，要在符合國(guó)際通行做法、不對(duì)國(guó)際貿(mào)易造成妨礙的同時(shí)，更加符合我國(guó)國(guó)情和經(jīng)濟(jì)社會(huì)發(fā)展程度，保護(hù)本國(guó)企業(yè)和本土市場(chǎng)的利益，促進(jìn)科技進(jìn)步和社會(huì)發(fā)展。第六章為結(jié)論，對(duì)本文的主要觀點(diǎn)進(jìn)行總括。
[Abstract]:Intellectual property rights as the core strategic resources in the era of knowledge economy, has become the world to promote economic development, social progress is one of the most important national strategy. With the pace of China's market economy and opening up, foreign and domestic intellectual property trade volume rising. Therefore, perfecting the protection system of intellectual property rights, normative knowledge property transactions, for the healthy development of China's economy, promote independent innovation and technological progress, it is very important and urgent. The customs in the part of the entry and exit of the importance of intellectual property protection is self-evident, and perfect the system of Customs Protection of intellectual property rights, protect intellectual property rights, the collection and balance of interests between the shipper and the public that should be the proper meaning of perfecting the protection system of intellectual property rights problem. In today's fierce competition in international trade, the abuse of rights Like emerge in an endless stream, the Customs Protection of intellectual property rights is more and more as a blow to the opponent, to seize the market, gain the monopoly profit tools, serious damage to the balance of interests, contrary to the original intention and purpose of the protection of intellectual property rights. In view of this, it is necessary to further improve the customs protection system of intellectual property rights, from the legislative level to effectively regulate the abuse of rights, straighten out intellectual property interests, to protect intellectual property rights and public interest balance, the system of Customs Protection of intellectual property rights protection, backsintosline, organic unity and regulation.
This paper focuses on the International (mainly based on TRIPS protocol) the relevant provisions of prohibition of abuse of rights and the Customs Protection of intellectual property rights system, and then from the filing of Customs Protection of intellectual property rights for the detention, investigation of a number of sectors, with the abuse of rights theory and practice of customs protection of intellectual property rights, analyzes the main rights forms of abuse and its effects, and from the two aspects of substantive law and procedural law, in-depth study of the phenomenon of abuse of rights reflects the existing system of Customs Protection of intellectual property rights in China, finally puts forward to perfect the system of Customs Protection of intellectual property rights in China from two aspects of legislation and law enforcement, abuse Regulation Countermeasures.
This paper is divided into 6 parts: the first chapter is the introduction, expounds the research purpose and significance, research status at home and abroad, puts forward research ideas, methods, content and structure; the second chapter is the basic theory of the Customs Protection of intellectual property rights, the basic concept, China Customs IPR protection briefly discusses the origin, basic establishment and the development of the system of Customs Protection of intellectual property rights, on this basis, the focus of "Prohibition of abuse of rights" as one of the basic principles of civil law embodied in the Customs Protection of intellectual property rights in the relevant provisions of regulation, rights in the current system the abuse of rights; the third chapter is the analysis of the Customs Protection of intellectual property rights in the phenomenon of abuse, from knowledge the filing of Customs Protection of property rights, application, detain, investigation and other sectors, combined with basic theory of abuse of rights, the relevant provisions of the customs protection program law and customs law enforcement practice, the abuse of right The specific performance for in-depth analysis, and on this basis, elaborated the abuse of rights and the consignor of import and export, customs and influence public and other stakeholders; the fourth chapter is the analysis of reasons of China's customs protection of intellectual property rights abuse, from two aspects of substantive law and procedural law, combined with the the change and development trend of global intellectual property protection and the situation, as well as the establishment and development of the system of Customs Protection of intellectual property rights in China's historical and realistic factors, the deep-seated legal reasons in-depth analysis of the abuse of rights, which reveal the existence of China's IPR customs protection system problems, mainly in the legislative tendency of intellectual property protection mode hand, mechanism and law enforcement procedures; the fifth chapter is the countermeasures and suggestions to prevent the rights of Customs Protection of intellectual property in our country abuse, combined with our country's customs protection of intellectual property rights Actually, from the legislation and law enforcement countermeasures and suggestions for the improvement of the two aspects of the regulation of the abuse of rights, emphasizing on Improving Customs Protection of intellectual property rights, in accordance with international practices, not hamper international trade at the same time, more in line with the national conditions and level of economic and social development in our country, protect domestic enterprises and local market interests, promote the progress of science and technology and social development. The sixth chapter is the conclusion, summed up the main points of this article.
