【摘要】：道地藥材是在具有特定的自然條件和特定地理生長環(huán)境下，經(jīng)當(dāng)?shù)靥囟ǖ墓に囍瞥�，藥效�?qiáng)于其他一般產(chǎn)區(qū)的藥材資源。道地藥材作為文化多樣性和生物多樣性的結(jié)合體，對我國的經(jīng)濟(jì)發(fā)展和人文文化傳承有著不可估量的作用。如何把道地藥材特有的文化優(yōu)勢、歷史優(yōu)勢和品質(zhì)優(yōu)勢轉(zhuǎn)化為知識(shí)產(chǎn)權(quán)優(yōu)勢，使我國的寶貴傳統(tǒng)知識(shí)和遺傳資源得以很好的存續(xù)和產(chǎn)業(yè)化發(fā)展，是當(dāng)今需要研究的重要課題。 本文的第一部分首先闡述道地藥材的基本概念、成因以及基于地域的自然特征的分類，并對道地藥材的生態(tài)特性和文化特性進(jìn)行界定。然后從公共健康、人權(quán)、經(jīng)濟(jì)學(xué)、歷史演進(jìn)和經(jīng)濟(jì)全球化發(fā)展等各個(gè)視角分析道地藥材知識(shí)產(chǎn)權(quán)保護(hù)的正當(dāng)性。 本文的第二部分分析當(dāng)前道地藥材的知識(shí)產(chǎn)權(quán)保護(hù)途徑。在道地藥材的生物多樣性保護(hù)方面，對植物新品種保護(hù)和種質(zhì)資源保護(hù)進(jìn)行了探討；在道地藥材的文化多樣性保護(hù)方面，論述了商業(yè)秘密保護(hù)和其他幾種保護(hù)模式；在道地藥材生物多樣性和文化多樣性結(jié)合的雙重保護(hù)方面，著重對其地理標(biāo)志保護(hù)進(jìn)行探討，并分析了道地藥材地理標(biāo)志保護(hù)中存在的問題和對策。 本文的第三部分對道地藥材知識(shí)產(chǎn)權(quán)保護(hù)進(jìn)行了實(shí)例研究，從文山三七、東阿阿膠等道地藥材的具體保護(hù)實(shí)踐中，得出道地藥材知識(shí)產(chǎn)權(quán)保護(hù)的啟示。 本文的第四部分探討我國道地藥材知識(shí)產(chǎn)權(quán)的探索保護(hù)中存在的問題�；趯栴}的分析與研究，給出促進(jìn)我國道地藥材產(chǎn)業(yè)可持續(xù)發(fā)展對策。
[Abstract]:Authentic medicinal materials are made under specific natural conditions and specific geographical conditions and through specific local processes, which are more effective than those of other general producing regions. The authentic medicinal materials are a combination of cultural diversity and biological diversity. It plays an inestimable role in the economic development and cultural heritage of our country. How to turn the unique cultural advantages, historical advantages and quality advantages of authentic medicinal materials into intellectual property advantages, The valuable traditional knowledge and genetic resources of our country can survive well and develop industrially, which is an important subject that needs to be studied. The first part of this paper first describes the basic concepts, causes and classification of native medicinal materials based on geographical natural characteristics, and defines the ecological and cultural characteristics of authentic medicinal materials, and then from the public health, human rights, economics, This paper analyzes the legitimacy of intellectual property protection of authentic medicinal materials from historical evolution and economic globalization. In the second part of this paper, the approaches of intellectual property protection of native medicinal materials are analyzed. In the aspect of biodiversity protection of native medicinal materials, the protection of new plant varieties and germplasm resources is discussed. In the aspect of cultural diversity protection of authentic medicinal materials, the trade secret protection and several other protection modes are discussed, and the protection of geographical indications of authentic medicinal materials is discussed in the dual protection of the combination of biological diversity and cultural diversity. The problems and countermeasures in the protection of geographical indications of authentic medicinal materials were analyzed. The third part of this paper has carried on the example research to the authentic medicinal material intellectual property protection, from the Wenshan Panax notoginseng, Donga Ejiao and so on authentic medicinal material concrete protection practice, obtains the authentic medicinal material intellectual property protection enlightenment. The 4th part of this paper discusses the problems existing in the exploration and protection of the intellectual property rights of the authentic medicinal materials in China. Based on the analysis and research of the problems, the countermeasures to promote the sustainable development of the traditional Chinese medicinal materials industry are put forward.
