【摘要】：國際知識產(chǎn)權法律在形式上由以多邊條約為主向多邊條約、區(qū)域性條約與雙邊條約共同發(fā)展轉變,由專門的知識產(chǎn)權條約向將知識產(chǎn)權內(nèi)容融入多邊、區(qū)域或雙邊自由貿(mào)易協(xié)定或投資協(xié)定中內(nèi)含知識產(chǎn)權法律規(guī)范轉變。在這種情況下私人部門對國際知識產(chǎn)權法律制度有著重大影響,無論是對于條約的整體意識還是實施程序,私人部門都具有舉足輕重的地位。因此,在我國企業(yè)走出去時,我國法律也應確立自己的知識產(chǎn)權權利清單、確立企業(yè)知識產(chǎn)權的確權意識與保護意識。
[Abstract]:In form, international intellectual property law has changed from multilateral treaties to multilateral treaties, regional treaties and bilateral treaties, from specialized intellectual property treaties to multilateral integration of intellectual property rights. Regional or bilateral free trade agreements or investment agreements contain changes in intellectual property legal norms... in which case the private sector has a significant impact on the legal regime of international intellectual property rights, both with regard to the overall awareness of treaties and procedures for implementation, Therefore, the law of our country should also establish its own list of intellectual property rights, and establish the consciousness of confirming and protecting the intellectual property rights of enterprises.
