【摘要】：非物質(zhì)文化遺產(chǎn)的國際知識(shí)產(chǎn)權(quán)法保護(hù)的形成具有理論來源和必備條件。其理論來源有"正義說"、"人格說"、"利益補(bǔ)償論說"。以理論來源為支撐,在知識(shí)產(chǎn)權(quán)國際化、人權(quán)保護(hù)國際化的背景和條件下,非物質(zhì)文化遺產(chǎn)的國際知識(shí)產(chǎn)權(quán)法保護(hù)應(yīng)運(yùn)而生。
[Abstract]:The formation of international intellectual property law protection of intangible cultural heritage has theoretical sources and necessary conditions. Its theoretical sources include "justice theory", "personality theory", "interest compensation theory", which is supported by theory source. Under the background and conditions of the internationalization of intellectual property rights and the protection of human rights, the international intellectual property law protection of intangible cultural heritage emerges as the times require.
