【摘要】：計算機程序是軟件產(chǎn)業(yè)的核心競爭力所在，對其進行全面深入的知識產(chǎn)權(quán)保護一直是各國法律界熱議的話題。隨著計算機程序的著作權(quán)保護逐漸式微，以美國為代表的軟件業(yè)大國紛紛開始向?qū)＠Ｗo模式傾斜。建立一套明確合理的計算機程序?qū)＠腕w審查標準是對計算機程序進行專利保護的基礎(chǔ)，但是，各國在具體的審查標準上仍然沒有達成統(tǒng)一的意見。如何通過完善我國現(xiàn)有的計算機程序?qū)＠腕w審查標準為計算機程序?qū)＠Ｗo提供指導，從而促進我國軟件產(chǎn)業(yè)的發(fā)展，是一個亟待解決的問題。本文從計算機程序的概念和特性出發(fā)，探尋了對計算機程序采取專利保護的必要性，通過借鑒美歐在計算機程序?qū)＠腕w審查標準方面的經(jīng)驗，對我國的計算機程序?qū)＠腕w審查標準提出完善。本文分為三章對以上問題進行具體研究： 第一章從計算機程序的概念談起，分析了計算機程序所具有的特點，并結(jié)合這些特點以及著作權(quán)制度、專利權(quán)制度的特性討論了對計算機程序進行專利保護的必要性。緊接著，文章論述了作為計算機程序?qū)＠Ｗo基礎(chǔ)的計算機程序?qū)＠腕w審查制度的重要性，介紹了計算機程序?qū)＠腕w審查標準的概念和功能。 第二章主要介紹了作為軟件業(yè)翹楚的美國和歐盟在計算機程序?qū)＠腕w審查標準上的觀點變化。本章詳細介紹了美國對計算機程序?qū)＠Ｗo從不保護到寬保護再到嚴保護的發(fā)展過程，重點評析了在這過程中形成的一系列不同的審查標準，并對美國當前實行的計算機程序?qū)＠腕w審查標準進行了介紹。歐盟方面，，本章主要介紹了歐盟在計算機程序?qū)＠腕w審查上一直遵循的“技術(shù)性”標準。本章在最后對美歐的經(jīng)驗進行了總結(jié)，為我國相關(guān)制度的借鑒奠定了基礎(chǔ)。 第三章通過遍歷我國現(xiàn)行立法中對計算機程序?qū)＠腕w審查標準的規(guī)定，逐項分析現(xiàn)行立法中存在的漏洞與不足，結(jié)合美歐在相關(guān)立法和實踐中的經(jīng)驗，最終從立法和實踐層面對我國計算機程序?qū)＠腕w審查標準提出完善。
[Abstract]:Computer program is the core competitiveness of the software industry, the comprehensive and in-depth protection of intellectual property rights has been a hot topic in the legal circles of various countries. With the decline of copyright protection of computer programs. The software countries represented by the United States have begun to tilt to the patent protection mode. It is the basis of patent protection to establish a set of clear and reasonable standards for the patent object examination of computer programs. Countries still have not reached a unified opinion on the specific examination standards. How to improve the existing computer program patent object examination standards to provide guidance for the computer program patent protection. In order to promote the development of software industry in China, it is an urgent problem to solve. This paper explores the necessity of patent protection of computer programs from the concept and characteristics of computer programs. By drawing lessons from the experience of the United States and Europe in the field of computer program patent object examination standard, the author puts forward the perfection of the computer program patent object examination standard in China. This paper is divided into three chapters to carry on the concrete research to the above question: The first chapter starts with the concept of computer program, analyzes the characteristics of computer program, and combines these characteristics as well as the copyright system. The characteristics of patent system discuss the necessity of patent protection for computer program. Then, the paper discusses the importance of the object examination system of computer program patent protection as the basis of computer program patent protection. This paper introduces the concept and function of the object examination standard of computer program patent. The second chapter mainly introduces the changes in the standards of computer program patent object examination in the United States and the European Union, which are the leaders of the software industry. This chapter introduces in detail that the United States never protects the computer program patent to the wide protection. And then to the development process of strict protection. This paper mainly analyzes a series of different standards of examination, and introduces the standards of the object examination of computer program patent in the United States. The European Union (EU). This chapter mainly introduces the "technical" standards that the EU has been following in the examination of the patented object of computer programs. At the end of this chapter, the experience of the United States and Europe is summarized, which lays a foundation for the reference of the relevant systems in our country. The third chapter analyzes the loopholes and shortcomings of the current legislation by traversing the provisions of the object examination standard of computer program patent in China's current legislation, combining the experience of the United States and Europe in the relevant legislation and practice. Finally, from the legislative and practical aspects, the object examination standard of computer program patent in China is improved.
