【摘要】：近年來,刑法修正案運(yùn)用多種修正策略,對刑法進(jìn)行重大修正,展現(xiàn)出刑法干預(yù)早期化、能動(dòng)化、犯罪圈不斷擴(kuò)大的立法趨向。這一趨向既不意味著法治國自由刑法的訴求已成過眼煙云,也不意味著積極的刑法立法觀在我國就此確立。犯罪圈擴(kuò)大的立法趨向在總體上具有客觀必然性和實(shí)踐合理性,但刑法修正案的某些條款在合目的性、明確性與體系邏輯性方面存在瑕疵;1997年刑法由"厲而不嚴(yán)"向"嚴(yán)而不厲"的結(jié)構(gòu)轉(zhuǎn)型尚未成功,碎片化的刑法修正案立法方式破壞了1997年刑法的外部面相和內(nèi)部邏輯;1997年刑法已經(jīng)進(jìn)入其生命周期的后期,應(yīng)適時(shí)啟動(dòng)對其的全面修訂,并且超越刑法典單軌立法模式,構(gòu)建刑法典與行政刑法的雙軌立法模式。
[Abstract]:In recent years, the amendment of criminal law has made great amendments to the criminal law by using a variety of amendment strategies, showing the legislative trend of the early, active and expanding criminal circle of criminal law intervention. This trend does not mean that the pursuit of free criminal law has become a thing of the past, nor does it mean that a positive view of criminal law legislation has been established in China. The legislative trend of the expansion of the criminal circle is generally objective necessity and practical rationality, but some articles of the Criminal Law Amendment are in line with the purpose. There are flaws in clarity and system logic, and the structural transformation of 1997 criminal law from "severe but lax" to "strict but not severe" has not yet been successful. The fragmented legislative method of the amendment of criminal law has destroyed the exterior and internal logic of the 1997 criminal law, and the 1997 criminal law has entered the later stage of its life cycle, so it should start the comprehensive revision in good time, and surpass the monorail legislative model of the criminal code. Construct the dual-track legislation mode of criminal code and administrative criminal law.
