【摘要】：近年來(lái),P2P網(wǎng)絡(luò)集資在迅速發(fā)展的同時(shí),出現(xiàn)了"無(wú)準(zhǔn)入門(mén)檻、無(wú)行業(yè)標(biāo)準(zhǔn)、無(wú)監(jiān)管機(jī)構(gòu)"的現(xiàn)象,其中涉及刑事犯罪的屢見(jiàn)不鮮。P2P網(wǎng)絡(luò)集資存在哪些刑事風(fēng)險(xiǎn)?對(duì)利用P2P網(wǎng)絡(luò)集資平臺(tái)開(kāi)展非法集資活動(dòng)的行為該如何定性?實(shí)踐中如何處理認(rèn)識(shí)分歧?近日,本刊與江蘇省常州市新北區(qū)檢察院遴選典型案例,共同邀請(qǐng)專(zhuān)家,就P2P網(wǎng)絡(luò)集資行為刑法規(guī)制及監(jiān)管等問(wèn)題進(jìn)行深入研討。
[Abstract]:In recent years, with the rapid development of P2P network financing, there appears the phenomenon of "no threshold of entry, no industry standard, no regulatory body", which involves the common occurrence of criminal crimes. What are the criminal risks of P2P network financing? How to make use of P2P network financing platform to carry out illegal fund-raising activities? How to deal with differences of understanding in practice? Recently, the Journal and the Xinbei District Procuratorate of Changzhou City, Jiangsu Province, selected typical cases and invited experts to conduct in-depth discussions on the criminal law regulation and supervision of P2P network fund-raising.
