【摘要】：在鄧玉嬌案中,反擊者在盡到必要容忍義務(wù)之后,可以將防衛(wèi)手段的選擇、防衛(wèi)強(qiáng)度的設(shè)定建立在侵犯者現(xiàn)實(shí)暴行和可能暴行的基礎(chǔ)上。正是侵犯者所營造的恐怖場景,使鄧玉嬌產(chǎn)生了錯(cuò)誤認(rèn)識,產(chǎn)生了對"正當(dāng)防衛(wèi)狀況的誤信"。反擊者為了阻止自己重傷或者死亡結(jié)果發(fā)生,就擁有了刑法賦予的無過當(dāng)防衛(wèi)權(quán),認(rèn)識錯(cuò)誤下的鄧玉嬌可以在沒有警告的情況下實(shí)施致命反擊。將鄧玉嬌的防衛(wèi)行為認(rèn)定為具有故意傷害的主觀不法,而對致死鄧貴大的結(jié)果則認(rèn)定為存在過失的主觀不法,其認(rèn)定結(jié)論使得認(rèn)識錯(cuò)誤與主觀不法無法兼容。
[Abstract]:In the case of Deng Yujiao, the retaliators can set up the choice of defense means and the setting of the defense intensity on the basis of the real atrocities and possible atrocities of the violators. It is the horror scene created by the violators, which makes Deng Yujiao misunderstood and produces misunderstandings of "the state of justifiable defense". In order to prevent a serious injury or the result of death, the criminal law endowed with the right of defenses, Deng Yujiao can carry out a fatal counterattack without warning. Deng Yujiao's defensive behavior is regarded as a subjective wrongful act of intentional injury, and the result of death Deng Guida is identified as a fault. The conclusion of the conclusion is that the cognitive errors and subjective errors can not be compatible.
