【摘要】：故意殺人案判處死刑相對于其他案件來說較為普遍,故意殺人案件的死刑執(zhí)行數(shù)量也占全部死刑案件的很大一部分。要減少死刑執(zhí)行數(shù)量,必須從占死刑案件大多數(shù)的故意殺人案件著手,所以,對故意殺人案件的死刑控制就顯得尤為重要。故意殺人案件是否應當判處死刑,關鍵在于量刑情節(jié)的不同,每一個案件的量刑情節(jié)所體現(xiàn)的量刑功能都與被告人和被害人的利益息息相關。本文通過七個故意殺人的典型案例分析不同犯罪情節(jié)在案件中的量刑功能,期盼能夠摸索出故意殺人案件判處死緩限制減刑的規(guī)律,在控制死刑執(zhí)行數(shù)量方面與刑罰的價值方面找到平衡,通過分析自首、坦白、累犯、民間矛盾引發(fā)、被害人家屬諒解、經濟賠償、親屬協(xié)助抓捕、殺人手段殘忍等量刑情節(jié)對故意殺人案適用死刑緩期兩年執(zhí)行并且限制減刑的影響,對于情節(jié)嚴重,社會危害大的故意殺人案件,可以考慮限制減刑,情節(jié)輕微,社會危害相對較小的案件,可以不限制減刑。
[Abstract]:The death penalty is more common in intentional homicide cases than in other cases, and the number of executions in intentional homicide cases also accounts for a large part of the total death penalty cases. In order to reduce the number of execution of death penalty, we must start from the intentional homicide cases which account for the majority of death penalty cases. Therefore, it is very important to control the death penalty in intentional homicide cases. Whether the death penalty should be imposed in a case of intentional homicide lies in the different circumstances of sentencing. The sentencing function embodied in the circumstances of each case is closely related to the interests of the defendant and the victim. Through seven typical cases of intentional homicide, this paper analyzes the sentencing function of different crime circumstances in the case, hoping to find out the law of the death penalty suspension limit commutation in the intentional homicide case. To find a balance between the control of the number of executions and the value of punishment, through analysis of voluntary surrender, confessions, recidivism, civil conflicts, understanding of victims' families, economic compensation, and relatives' assistance in apprehending, Cruel means of murder and other sentencing circumstances apply the death penalty in cases of intentional homicide for a period of two years and limit the impact of commutation of the sentence. In cases of intentional homicide where the circumstances are serious and social harm is great, consideration may be given to limiting the commutation of the sentence, the circumstances being minor, In cases where social harm is relatively small, commutation of sentence may not be restricted.
