【摘要】：網(wǎng)絡(luò)時(shí)代的到來(lái)確實(shí)給人類(lèi)帶來(lái)了巨大的變化，也給人權(quán)體系提出了全新的問(wèn)題和挑戰(zhàn)。表達(dá)自由在互聯(lián)網(wǎng)這一媒介下發(fā)展出了一系列新的表現(xiàn)形式，因?yàn)榛ヂ?lián)網(wǎng)在傳遞信息和言論上的所具有的高速特質(zhì)，使得傳統(tǒng)的規(guī)制措施開(kāi)始顯示出疲態(tài)，同時(shí)我國(guó)互聯(lián)網(wǎng)中對(duì)表達(dá)自由的實(shí)現(xiàn)存在許多現(xiàn)實(shí)障礙，加上規(guī)范的法律法規(guī)也不足，如何對(duì)這些形式做出合法合理的規(guī)制均需要我們深入思考。 筆者在大量總結(jié)前人研究成果的基礎(chǔ)上具體分析了表達(dá)自由的價(jià)值和在人權(quán)體系中的地位，整理、選取了在我國(guó)實(shí)踐中突出的幾個(gè)關(guān)鍵環(huán)節(jié)，運(yùn)用比較分析法和總結(jié)經(jīng)驗(yàn)法，穿插實(shí)際案例，試著分析出存在的矛盾和問(wèn)題，輔之以國(guó)外經(jīng)驗(yàn)并提出了自己的見(jiàn)解和解決手段。 本論文共分為四章，第一章主要是簡(jiǎn)要闡述了表達(dá)自由的基本概念；第二章指出了關(guān)于表達(dá)自由的一些基本原則和規(guī)制方法以及國(guó)外的經(jīng)驗(yàn)，特別是說(shuō)明如果要限制表達(dá)自由必須給予正當(dāng)?shù)睦碛梢约笆侄魏戏ǎ坏谌屡c第四章則將眼光投向我國(guó)的現(xiàn)實(shí)生活，在了解、分析具體問(wèn)題后，旨在暴露我國(guó)保護(hù)互聯(lián)網(wǎng)表達(dá)自由的弊端，并針對(duì)問(wèn)題提出了解決方案。
[Abstract]:The advent of the Internet era has brought great changes to human beings, as well as posed new problems and challenges to the human rights system. Freedom of expression has developed a series of new forms of expression under the medium of the Internet, because of the high-speed nature of the Internet in transmitting information and speech, the traditional regulatory measures have begun to show fatigue. At the same time, there are many practical obstacles to the realization of freedom of expression in the Internet of our country, and the standard laws and regulations are also insufficient, how to make the legal and reasonable regulation of these forms all need us to think deeply. The author analyzes the value of freedom of expression and its position in the human rights system on the basis of summing up a large number of previous research results, and selects several key links that stand out in the practice of our country, and applies comparative analysis method and summing up experience method. Interspersing practical cases, trying to analyze the existing contradictions and problems, supplemented by foreign experience and put forward their own views and solutions. This paper is divided into four chapters, the first chapter is a brief introduction of the basic concept of freedom of expression; The second chapter points out some basic principles and regulation methods of freedom of expression as well as the experience of foreign countries, especially shows that if we want to restrict freedom of expression, we must give legitimate reasons and legal means; The third and fourth chapters focus on the real life of our country. After understanding and analyzing the specific problems, it aims to expose the disadvantages of protecting the freedom of expression on the Internet in our country, and put forward solutions to the problems.
