【摘要】：村民自治權(quán)是村民自治制度的核心，只有確保村民自治權(quán)在廣大農(nóng)村地區(qū)，健康、有序、協(xié)調(diào)的發(fā)展，才能使廣大農(nóng)民實(shí)現(xiàn)當(dāng)家做主的愿望。本文從村民自治權(quán)的基礎(chǔ)理論入手，分析阻礙村民自治權(quán)運(yùn)行的問(wèn)題并找出原因，，針對(duì)問(wèn)題提出保障村民自治權(quán)的法律意見(jiàn)。 文章除了序言部分外，分為三個(gè)部分： 第一部分：我國(guó)村民自治的基本理論。本部分以村民自治權(quán)為切入點(diǎn)，分析村民自治權(quán)的概念、性質(zhì)、特征、內(nèi)容，完整的表述村民自治權(quán)內(nèi)涵；從歷史上的發(fā)展和我國(guó)的特殊國(guó)情來(lái)分析我國(guó)實(shí)行村民自治的必要性，與歷史上的鄉(xiāng)村治理一脈相承性；借鑒國(guó)外資本主義國(guó)家的地方自治理論和社會(huì)主義國(guó)家人民自治理論，指導(dǎo)我國(guó)村民自治制度的發(fā)展。 第二部分：我國(guó)村民自治權(quán)存在的法律問(wèn)題及成因分析。本部分論述的是村民自治權(quán)在實(shí)踐運(yùn)行中出現(xiàn)了障礙，阻礙了村民行使當(dāng)家做主的民主權(quán)利。從村民自治權(quán)的四個(gè)組成部分，民主選舉權(quán)、民主監(jiān)督權(quán)、民主決策權(quán)、民主管理權(quán)在實(shí)施中遇到的困難來(lái)分析實(shí)施村民自治權(quán)的困難所在。找出造成村民自治權(quán)出現(xiàn)困難的原因，是由于法律制度的不健全、國(guó)家公權(quán)力的侵害、和我國(guó)農(nóng)村問(wèn)題的復(fù)雜性等原因造成的。 第三部分：我國(guó)村民自治權(quán)制度完善與法律保障建議。上部分分析了我國(guó)村民自治權(quán)運(yùn)行中出現(xiàn)困難的原因，本部分針對(duì)上部分的問(wèn)題提出解決問(wèn)題的意見(jiàn)。應(yīng)該從完善以憲法和村民委員會(huì)組織法為代表的實(shí)體法，制定村民自治法和程序法從制度上保障村民自治權(quán)；引入司法救濟(jì)途徑，使得村民自治權(quán)有了司法保障；與司法救濟(jì)相對(duì)應(yīng)的非訴訟程序也應(yīng)當(dāng)被完善，具體包括行政救濟(jì)、人大和信訪救濟(jì)、法律援助制度等等。
[Abstract]:Villager autonomy is the core of villager autonomy system. Only by ensuring the healthy, orderly and coordinated development of villager autonomy in rural areas can the majority of peasants realize their wish to be masters of their own house. Starting from the basic theory of villagers' autonomy, this paper analyzes the problems that hinder the operation of villagers' autonomy and finds out the reasons, and puts forward some legal opinions to protect villagers' autonomy. In addition to the preamble, the article is divided into three parts: The first part: the basic theory of villager autonomy in our country. This part takes the villager autonomy as the breakthrough point, analyzes the concept, the nature, the characteristic, the content, the complete expression villager autonomy connotation; From the historical development and the special national conditions of our country, this paper analyzes the necessity of implementing villager autonomy in our country, which is in line with the history of rural governance, and draws lessons from the local autonomy theory of foreign capitalist countries and the people's autonomy theory of socialist countries. To guide the development of villager autonomy system in China. The second part: the legal problems and causes of villager autonomy in China. This part discusses the obstacles of villagers' autonomy in practice, which hinders villagers to exercise their democratic rights as masters. This paper analyzes the difficulties in the implementation of villagers' autonomy from the aspects of the four components of villagers' autonomy, democratic voting right, democratic supervision power, democratic decision-making power and democratic management right. To find out the reasons for the difficulties of villagers' autonomy are caused by the imperfection of the legal system, the infringement of the state's public power, and the complexity of the rural problems in our country. The third part: our country villager autonomy system consummation and the legal safeguard suggestion. The first part analyzes the reasons for the difficulties in the operation of the villagers' autonomy in our country, and puts forward some suggestions to solve the problems in the above part. We should perfect the substantive law represented by the Constitution and the Organic Law of the villagers' Committee, formulate the law of villager autonomy and the law of procedure to protect the villagers' autonomy from the system, introduce the way of judicial relief, and make the villagers' autonomy have the judicial guarantee. The non-litigation procedure corresponding to the judicial remedy should also be perfected, including administrative relief, people's Congress and petition relief, legal aid system and so on.
