【摘要】:食物權(quán)是一項(xiàng)獨(dú)立存在的基本人權(quán),屬于經(jīng)濟(jì)、社會(huì)和文化權(quán)利范疇,在《世界人權(quán)宣言》、《經(jīng)濟(jì)、社會(huì)和文化權(quán)利國(guó)際公約》及相關(guān)文件中得到確認(rèn),所有締約國(guó)對(duì)國(guó)度內(nèi)生活的公民所享有的食物權(quán)均負(fù)有尊重、保護(hù)和實(shí)現(xiàn)的義務(wù)。 我國(guó)現(xiàn)行的法律體系對(duì)公民食物權(quán)的保護(hù)存在很多缺陷和不足:在立法方面,我國(guó)憲法及其他法律均沒有明確食物權(quán);在執(zhí)法方面,我國(guó)食物安全惡性事件頻發(fā),嚴(yán)重威脅著公民的生命健康,貧困問題普遍存在;在司法上,法律救濟(jì)途徑不暢等。因此,完善我國(guó)公民食物權(quán)法律保護(hù)任重道遠(yuǎn)。 本文主要包括四個(gè)部分:第一部分指出食物權(quán)的人權(quán)屬性,并概述食物權(quán)概念和內(nèi)容,強(qiáng)調(diào)國(guó)家對(duì)公民食物權(quán)的義務(wù);第二部分客觀概述我國(guó)食物權(quán)法律保護(hù)現(xiàn)狀以及存在的食物安全問題和貧困問題,并深入分析這兩大問題產(chǎn)生的原因;第三部分簡(jiǎn)要介紹相關(guān)國(guó)家對(duì)食物權(quán)的立法保護(hù)、執(zhí)法保護(hù)和司法保護(hù),總結(jié)國(guó)外食物權(quán)法律保護(hù)對(duì)我國(guó)的啟示;第四部分通過借鑒和吸收國(guó)外的成功經(jīng)驗(yàn),結(jié)合本國(guó)國(guó)情,從立法保護(hù)、執(zhí)法保護(hù)和司法保護(hù)三個(gè)方面分別提出完善我國(guó)公民食物權(quán)法律保護(hù)的可行建議。
[Abstract]:The right to food is an independent and fundamental human right that falls within the scope of economic, social and cultural rights and is recognized in the Universal Declaration of Human Rights, the International Covenant on Economic, Social and Cultural Rights and related documents, All States parties have an obligation to respect, protect and fulfil the right to food enjoyed by citizens living in the country. The current legal system of our country has many defects and deficiencies in the protection of citizens' right to food: in the aspect of legislation, the Constitution and other laws of our country have not defined the right to food; in the aspect of law enforcement, the vicious incidents of food safety in our country occur frequently. It is a serious threat to the life and health of citizens, and the problem of poverty is widespread. Therefore, it is a long way to perfect the legal protection of Chinese citizens' right to food. This paper mainly includes four parts: the first part points out the human rights attribute of the right to food, summarizes the concept and content of the right to food, and emphasizes the obligation of the state to the right to food; The second part gives an objective overview of the current situation of the legal protection of the right to food and the problems of food security and poverty in China, and analyzes the causes of these two problems in depth. The third part briefly introduces the legislative protection of the right to food in the relevant countries. Law enforcement protection and judicial protection, summed up the foreign legal protection of the right to food inspiration to China; part IV through the reference and absorption of successful experience of foreign countries, combined with the national conditions, from the legislative protection, Three aspects of law enforcement protection and judicial protection are put forward to improve the legal protection of citizens' right to food.
