【摘要】：香港特別行政區(qū)法院針對集會游行自由的主流審判法理是,集會游行權(quán)屬基本權(quán)利,但該權(quán)利不是絕對的,仍須與公共利益、他人的權(quán)利和自由相權(quán)衡。在保障和規(guī)限之間的司法衡平基準(zhǔn)是,任何限制該權(quán)利的特區(qū)立法或行政舉措均須受制于"依法規(guī)限、民主社會所需、必要性"等三個要素的嚴(yán)格司法審查。集會游行自由在公、私物業(yè)場域的法律邊界存在著一個寬廣的"型譜",該型譜與集會自由之限制程度相關(guān)聯(lián),法官應(yīng)結(jié)合相關(guān)要素就個案依法作出理性的判斷。針對超越集會游行自由邊界的違法行為,應(yīng)嚴(yán)格依循罪刑法定、舉證責(zé)任由控方承擔(dān)的刑事法治原則,在量刑上應(yīng)充分考慮基本人權(quán)因素。針對集會游行中激進(jìn)化、暴力化現(xiàn)象日益蔓延的趨勢,有必要發(fā)揮刑罰震懾性功能。
[Abstract]:The mainstream jurisprudence of the courts of the Hong Kong Special Administrative region against the freedom of assembly and procession is that the right to assembly and procession is a fundamental right, but this right is not absolute and must be weighed against the public interest, the rights and freedoms of others. The criterion of judicial balance between protection and restriction is that any legislation or administrative measure of the SAR which restricts this right must be subject to the strict judicial review of the three elements: "according to law, what a democratic society needs, and what is necessary". The freedom of assembly and procession exists a broad "pattern spectrum" in the legal boundary of public and private property field, which is related to the degree of restriction of freedom of assembly. The judge should make a rational judgment on the case according to law combined with the relevant elements. In view of the illegal behavior beyond the boundary of the freedom of assembly and procession, we should strictly abide by the legality of the crime, the burden of proof should be borne by the prosecution, and the basic human rights factors should be fully considered in sentencing. In view of the trend of radicalization and violence in rallies and processions, it is necessary to exert the deterrent function of punishment.
