【摘要】：公民基本權(quán)利限制是權(quán)利理論的重要內(nèi)容,是基本權(quán)利保障的一個(gè)部分,也是權(quán)利得以實(shí)現(xiàn)的前提。文章以黑格爾法哲學(xué)自由理論的重新解讀為前提,通過權(quán)利與自由之間內(nèi)在邏輯的自我證成,運(yùn)用黑格爾自由理論對(duì)公民基本權(quán)利限制進(jìn)行探討,以期從理論的深層次上揭示基本權(quán)利限制理論的合理性和必然性,為其實(shí)踐提供足夠的理論支撐。
[Abstract]:The restriction of citizens' basic rights is an important part of the theory of rights, a part of the protection of basic rights, and a prerequisite for the realization of rights.Based on the reinterpretation of the freedom theory of Hegel's philosophy of law, this paper discusses the restriction of citizens' basic rights by applying Hegel's freedom theory through the self-proof of the inherent logic between right and freedom.The aim is to reveal the rationality and inevitability of the basic right restriction theory from the deep level of the theory, and to provide sufficient theoretical support for its practice.
