【摘要】:作為公民基本權(quán)利的受教育權(quán)作為一種權(quán)利形態(tài)進入憲法視線是在近代資產(chǎn)階級革命時期,它與近代社會經(jīng)濟、政治、文化、教育發(fā)展息息相關(guān),是人類歷史進步的結(jié)果。公民受教育權(quán)是自由權(quán)和社會權(quán)的屬性兼而有之。作為自由權(quán)的受教育權(quán),要求國家不得制定侵犯公民自由權(quán)利的法律和要求國家不得非法干預教育自由,尊重教育發(fā)展規(guī)律。受教育權(quán)主要是以社會權(quán)的形態(tài)表現(xiàn)出來,作為社會權(quán)的受教育權(quán),其實現(xiàn)需要國家積極的作為,為教育的實施準備充分的外部條件,同時也要進行干預及控制。干預和控制的正當性在于受教育權(quán)這一基本權(quán)利不僅僅只是對國家的總體目標具有工具性價值,其內(nèi)在的和根本的價值在于促進公民個體的自我提升和自我實現(xiàn)。還應(yīng)從基本權(quán)利的性質(zhì)中體會國家干預和控制的正當性。
[Abstract]:The right to education as the basic rights of citizens as a form of rights into constitution is in the sight of modern bourgeois revolution, it and modern social economy, politics, culture, education is closely related to the development of human history, is the result of the progress. Citizens' right to education is a property of both freedom and social right. The right to education as a free right, state shall make national laws and requirements of infringement of civil liberties may illegally interfere with freedom of education, respect for the law of the development of education. The right to education is mainly displayed in the form of a social right, the right to education as a social right, in fact we need as a positive state, fully prepared for external conditions for education the implementation must also intervene and control. The legitimacy of the intervention and control of the basic rights of the right to education is not only the overall of national standard with The intrinsic and fundamental value of instrumental value lies in promoting the self promotion and self actualization of citizens. We should also understand the legitimacy of state intervention and control from the nature of basic rights.
