【摘要】：民族區(qū)域自治法頒布30多年了,雖然進(jìn)行了一次修改,但仍然活力不夠,不能適應(yīng)時(shí)代的要求,原有的"瑕疵"并未得到修正。因此,啟動(dòng)民族區(qū)域自治法的修訂程序,通過(guò)修法途徑來(lái)完成民族區(qū)域自治制度的"頂層設(shè)計(jì)",這是完善民族法律體系的基礎(chǔ),確保完善民族區(qū)域自治制度的步伐在法治軌道上推進(jìn)。修法應(yīng)充分體現(xiàn)憲法的旨意,明確自治機(jī)關(guān)的權(quán)力與義務(wù),增加法律責(zé)任的條款、創(chuàng)設(shè)違法制裁機(jī)制,激活民族區(qū)域自治法的功能,這是修改民族區(qū)域自治法應(yīng)該著力解決的問(wèn)題。
[Abstract]:More than 30 years after the promulgation of the Law on Regional National Autonomy, although it has been amended once, it is still not energetic enough to adapt to the requirements of the times, and the original "flaws" have not been amended. Therefore, the revision procedure of the Law on Regional National Autonomy has been initiated. The "top-level design" of the system of regional national autonomy is completed through the way of amending the law, which is the basis of perfecting the national legal system and ensuring that the pace of perfecting the system of regional autonomy of nationalities is advanced on the track of rule of law. The amendment of the law should fully reflect the will of the constitution. To clarify the power and obligation of the organs of self-government, to increase the terms of legal responsibility, to create the illegal sanction mechanism and to activate the function of the law of regional national autonomy are the problems that should be solved in the revision of the law of regional national autonomy.
