【摘要】：時代飛速前進(jìn)的當(dāng)下,在人們享受著豐富的物質(zhì)生活的同時,對娛樂生活的要求也越來越高,作為娛樂生活的重要角色的明星,公眾不再滿足對其工作、作品的了解,明星的個人信息也越來越吸引公眾的眼球,媒體的迅猛發(fā)展正好迎合了人們對娛樂生活的需求,相應(yīng)的也產(chǎn)生了許多媒體報道明星隱私新聞的現(xiàn)象。報道權(quán)與隱私權(quán)都是我國《憲法》規(guī)定的基本權(quán)利,報道權(quán)與隱私權(quán)對社會的發(fā)展與人格的完善起著不可替代的作用。明星隱私權(quán)常與媒體報道權(quán)相沖突的主要表現(xiàn),明星隱私常常被媒體以非法手段獲取后大肆報道。但由于我國隱私權(quán)保護(hù)起步較晚,隱私權(quán)保護(hù)規(guī)定的不完善,明星很難用法律武器保護(hù)自己。這種狀況的持續(xù)不僅不利于明星公民權(quán)利的保護(hù),也會阻礙我國法治社會的建設(shè)。本文以卓偉偷拍事件為例,從法律的角度對媒體報道明星隱私新聞的界限進(jìn)行分析,并對此問題的解決提出適當(dāng)?shù)姆山ㄗh,為司法實踐提供參考。
[Abstract]:With the rapid development of the times, people are enjoying rich material life, and at the same time, the requirements for entertainment life are becoming higher and higher. As the star of entertainment life, the public no longer satisfies their understanding of their work and works. Personal information of stars is attracting more and more public attention, and the rapid development of the media has catered to people's needs for entertainment. Accordingly, many media reports on star privacy news have emerged. Both the right to report and the right to privacy are the basic rights stipulated in the Constitution of our country. The right to report and the right to privacy play an irreplaceable role in the development of society and the perfection of personality. Star privacy is often reported by the media after it has been obtained by illegal means. However, due to the late start of privacy protection in China, the privacy protection regulations are not perfect. It is very difficult for stars to protect themselves with legal weapons. The persistence of this situation is not only detrimental to the protection of the rights of star citizens, but also hinders the construction of a society governed by law in our country. This article takes the case of Zhuo Wei as an example. This paper analyzes the limits of media coverage of star privacy news from the angle of law, and puts forward appropriate legal suggestions to solve this problem, which provides a reference for judicial practice.
