【摘要】：互聯(lián)網(wǎng)的高速發(fā)展給我們整個社會帶來了一場變革，公民在網(wǎng)絡上可以隨意發(fā)表自己的觀點，抒發(fā)自己的情緒。網(wǎng)絡的發(fā)展為公民監(jiān)督權的實現(xiàn)提供了全新的方式和平臺，而公民監(jiān)督權也在網(wǎng)絡空間下有了新的內涵和外延。公民通過網(wǎng)絡能夠及時獲得黨和國家出臺的各項方針、政策，并對政府及其工作人員的公務行為進行監(jiān)督，對不滿現(xiàn)象提出批評和建議。通過網(wǎng)絡這一平臺，公民的監(jiān)督權利在行使上又多了一種有效途徑，進而誕生了一種新的監(jiān)督權利——網(wǎng)絡監(jiān)督權。網(wǎng)絡監(jiān)督權憑借其高效便捷等優(yōu)勢深受大眾親睞，有力地提高了公民政治熱情，使公民敢于對不法行為進行揭發(fā)，對不滿情緒進行發(fā)泄。但是，網(wǎng)絡因其虛擬性使網(wǎng)絡監(jiān)督權自身又存在一些缺陷，由于公民在互聯(lián)網(wǎng)上通過匿名的方式發(fā)表言論，一些人借著行使監(jiān)督權在網(wǎng)上發(fā)表虛假信息，煽動群眾，，或者打著反腐的旗號對政府官員及其家人進行人肉搜索，進而侵犯當事人及其家人的隱私權利，給其造成嚴重的傷害。如何使公民網(wǎng)絡監(jiān)督權規(guī)范有效的行使，是我國政府急需解決的問題。 本文通過對公民網(wǎng)絡監(jiān)督權的內涵進行闡述，探討其區(qū)別于傳統(tǒng)監(jiān)督方式而存在的特點及其在當今社會存在的意義。通過對國外網(wǎng)絡監(jiān)督權行使現(xiàn)狀的介紹，分析我國公民網(wǎng)絡監(jiān)督權在行使中出現(xiàn)的困境及其原因，重點討論我國公民網(wǎng)絡監(jiān)督權規(guī)范化行使的原則和措施。通過加強網(wǎng)絡立法及各方面的協(xié)作，來引導公民能夠更加規(guī)范有效地行使網(wǎng)絡監(jiān)督權，使其發(fā)揮更佳效果。
[Abstract]:The rapid development of the Internet has brought a revolution to our entire society. Citizens can freely express their views and express their emotions on the Internet. The development of the Internet provides a new way and platform for the realization of the right of citizen supervision. And the right of citizen supervision also has a new connotation and extension under the cyberspace. Citizens can get all the principles and policies issued by the party and the state in time through the network, and supervise the official behavior of the government and its staff. Criticism and suggestions on the phenomenon of discontent. Through the platform of the Internet, citizens' supervisory rights have been exercised in an effective way. Then a new kind of supervision right, the right of network supervision, was born. The power of network supervision was favored by the public by virtue of its advantages such as high efficiency and convenience. The power to raise citizens' political enthusiasm and make citizens dare to expose illegal acts. However, because of its virtual nature, the Internet has some defects in its right to supervise the Internet. Because citizens express their opinions anonymously on the Internet, some people use the exercise of supervision to publish false information on the Internet. Inciting the masses, or carrying out human flesh searches on government officials and their families under the pretext of anti-corruption, thereby infringing on the privacy rights of the parties and their families, causing serious harm to them. It is an urgent problem for our government to solve. In this paper, the connotation of citizen's network supervision power is expounded, and the characteristics and significance of its existence are discussed, which are different from the traditional supervision mode, and the present situation of the exercise of network supervision power in foreign countries is introduced. This paper analyzes on the difficulties and causes of the exercise of the citizen's network supervision power in China, and discusses emphatically the principles and measures for the standardized exercise of the citizen's network supervision power. To guide citizens to exercise network supervision more standardized and effective, so that it can play a better effect.
