義務(wù)教育學(xué)生的教育經(jīng)濟(jì)福利權(quán)利及其立法保障研究

【摘要】:受教育權(quán)是憲法賦予每個公民的基本權(quán)利,在受教育權(quán)基礎(chǔ)上發(fā)展起來的教育經(jīng)濟(jì)福利權(quán)也是學(xué)生應(yīng)當(dāng)享有的權(quán)利。福利是個人所獲得的效用或滿足,福利權(quán)是基于這種效用或滿足的動態(tài)發(fā)展的、向上開放的權(quán)利體系,包括終極目標(biāo)是實現(xiàn)的自由權(quán),其最基本的底線是生存權(quán)和發(fā)展權(quán)。義務(wù)教育階段學(xué)生的教育經(jīng)濟(jì)福利權(quán)利實際上就是保障學(xué)生的發(fā)展權(quán),學(xué)生可以通過自由行使教育經(jīng)濟(jì)福利權(quán)利來改善自己的學(xué)習(xí)環(huán)境,追求自身更好的發(fā)展。 本文主要從義務(wù)教育階段學(xué)生的教育經(jīng)濟(jì)福利權(quán)利的概念入手,,分析其性質(zhì)和類型,通過對意義的理解總結(jié)歸納出應(yīng)在保障義務(wù)教育階段學(xué)生教育經(jīng)濟(jì)福利權(quán)利的法律中明確的主要內(nèi)容,闡明我國目前在學(xué)生的教育經(jīng)濟(jì)福利權(quán)利保護(hù)的現(xiàn)狀和存在的問題!坝袡(quán)利,即有救濟(jì);有救濟(jì),斯為權(quán)利”,體現(xiàn)了權(quán)利和救濟(jì)之間的緊密聯(lián)系。義務(wù)教育階段學(xué)生的教育經(jīng)濟(jì)福利權(quán)的救濟(jì)依然還是要通過法律來保護(hù)。國外學(xué)生的教育經(jīng)濟(jì)福利權(quán)立法保障的發(fā)展已經(jīng)相當(dāng)成熟,權(quán)利救濟(jì)也自成體系。通過與國外的立法保障現(xiàn)狀進(jìn)行對比分析,試圖對我國義務(wù)教育階段學(xué)生的教育經(jīng)濟(jì)福利權(quán)利的立法保障提出完善意見,在我國現(xiàn)有的教育法律法規(guī)的基礎(chǔ)上,擁有一部專門的保障義務(wù)教育階段學(xué)生的教育經(jīng)濟(jì)福利權(quán)利的法律規(guī)范。
[Abstract]:The right to education is a basic right given by the Constitution to every citizen, and the right to economic welfare of education, which is developed on the basis of the right to education, is also the right that students should enjoy. The right to welfare is based on this dynamic development of utility or satisfaction, an upward open system of rights, including the ultimate goal of the realization of the right to freedom. The most basic bottom line is the right to exist and the right to development. In fact, the right to economic welfare of students in compulsory education stage is to protect the right to development of students. Students can improve their learning environment and pursue their own better development by freely exercising the right of educational economic welfare. This paper starts with the concept of the economic welfare right of the students in the compulsory education stage and analyzes its nature and type. Through the understanding of meaning summed up the main content that should be clearly defined in the protection of the compulsory education stage students' right to economic and social welfare of education. Expound the present situation and existing problems of the protection of the right of education and economic welfare of students in our country at present. "have the right, that is to say, there is relief;" If there is relief, it is the right. " It reflects the close connection between right and relief. The relief of students' right to educational economic welfare is still to be protected by law. The development of foreign students' right to educational economic welfare has been developed. When it matures. Right relief is also a system. Through the comparative analysis of the current situation of the legislative protection of foreign countries, this paper tries to improve the legislative protection of the right of education economic welfare of the students in compulsory education stage in our country. On the basis of the existing educational laws and regulations in our country, there is a special legal norm to guarantee the educational economic welfare rights of the students in the compulsory education stage.
