【摘要】：本文分五部分來論述我國公民平等權(quán)的憲法保障。第一部分對公民平等權(quán)基本理論進行概述,分析了中西方平等權(quán)思想的溯源與發(fā)展,對平等權(quán)的性質(zhì)、定義和分類進行系統(tǒng)了的梳理；第二部分對我國公民平等權(quán)憲法保障中出現(xiàn)的問題進行了分析和闡述,從指導(dǎo)思想、規(guī)范、立法和司法幾個方面分析了我國公民平等權(quán)受到侵害的情況。第三部分對外國公民平等權(quán)憲法保障進行比較分析,對英美法系和大陸法系主要國家公民平等權(quán)的憲法保障進行了比較分析,總結(jié)出他們具有的實踐優(yōu)勢和經(jīng)驗。第四部分闡明了保障我國公民平等權(quán)有什么樣的意義,可以達到什么樣的效果和目的。第五部分就如何完善我國公民平等權(quán)的憲法保障,提出了幾點思考。 公民平等權(quán)的憲法保障是歷史發(fā)展的潮流,是構(gòu)建法治社會和社會主義和諧社會的民主發(fā)展戰(zhàn)略,因此我們要完善相關(guān)的理論和制度來切實保障我國公民的平等權(quán)。
[Abstract]:This paper is divided into five parts to discuss the constitutional protection of the right to equality of citizens. The first part summarizes the basic theory of equal rights of citizens, analyzes the origin and development of equality rights in China and the West, and the nature of the right to equality. Definition and classification of systematic combing; The second part analyzes and expounds the problems in the constitutional guarantee of equal rights of citizens in China, from the guiding ideology, norms. The legislative and judicial aspects of the analysis of the violation of the right to equality of citizens in China. Part three is a comparative analysis of the constitutional protection of the right to equality of foreign citizens. This paper makes a comparative analysis of the constitutional guarantee of the equality of citizens in the main countries of the common law system and the civil law system. It summarizes their practical advantages and experiences. Part 4th illustrates the significance of ensuring the equal rights of Chinese citizens. Part 5th puts forward some thoughts on how to perfect the constitutional guarantee of equal rights of citizens in China. The constitutional guarantee of citizens' right to equality is the trend of historical development and the democratic development strategy of constructing a society ruled by law and a harmonious socialist society. Therefore, we should improve the relevant theory and system to ensure the equality of our citizens.
