公有住房租賃權(quán)繼承法律問(wèn)題研究

【摘要】:公有住房制度是在計(jì)劃經(jīng)濟(jì)時(shí)期出現(xiàn)的,是我國(guó)特有的一種制度,公有住房租賃制度具有明顯的福利性特點(diǎn)。從所有權(quán)歸屬來(lái)看,公有住房屬于國(guó)家,但使用和收益的權(quán)利屬于承租人。公有住房租賃從出現(xiàn)到現(xiàn)在已經(jīng)有幾十年的時(shí)間,學(xué)界對(duì)其進(jìn)行了非常多的探討,但因其性質(zhì)復(fù)雜,對(duì)公有住房租賃權(quán)的法律屬性的界定尚不明確,該項(xiàng)租賃權(quán)是否能夠被繼承,理論與實(shí)務(wù)界對(duì)此一直存有較大爭(zhēng)論,承租權(quán)繼承相關(guān)方面的法律制度建設(shè)也尚存有較大空白,而各地根據(jù)本地實(shí)際情況出臺(tái)了關(guān)于公有住房租賃問(wèn)題的政策法規(guī)。由于尚未統(tǒng)一的立法規(guī)定,致使實(shí)踐中產(chǎn)生的新矛盾較多。本著實(shí)現(xiàn)“住有所居”的目的,本文從界定公有住房和公有住房租賃權(quán)的概念內(nèi)涵入手,對(duì)公有住房租賃權(quán)的特征、性質(zhì)進(jìn)行了深入的研究,并結(jié)合公有住房租賃在實(shí)際生活中出現(xiàn)的問(wèn)題,闡述了公有住房租賃權(quán)是一種具有物權(quán)性質(zhì)的債權(quán),是能夠被繼承的。本文研究過(guò)程中,將公有住房租賃權(quán)與普通的租賃權(quán)、土地承包經(jīng)營(yíng)權(quán)及德國(guó)長(zhǎng)期居住權(quán)制度對(duì)比,從立法、司法等多層面就如何完善我國(guó)公有住房承租權(quán)制度,如何建立該承租權(quán)繼承模式提出了具體的建議,并重點(diǎn)對(duì)公有住房承租人及相關(guān)權(quán)利人的利益保護(hù)問(wèn)題進(jìn)行了重點(diǎn)闡述,以期對(duì)我國(guó)公有住房租賃權(quán)繼承法律制度的完善起到一定的借鑒意義。
[Abstract]:The public housing system appeared in the planned economy period and is a special system in our country. The public housing rental system has obvious welfare characteristics. In terms of ownership, public housing belongs to the state, but the right to use and benefit belongs to the lessee. It has been several decades since the public housing lease appeared, but because of its complex nature, the definition of the legal attribute of the public housing rental right is not clear. Whether the lease right can be inherited has always been debated in the theoretical and practical circles, and there is still a big gap in the construction of the legal system related to the inheritance of the lease right. And local according to the actual situation on the issue of public housing rental policies and regulations. Due to the lack of uniform legislative provisions, there are many new contradictions in practice. In order to realize the purpose of "living in a house", this paper begins with the definition of the concept of public housing and the lease right of public housing, and makes a deep study on the characteristics and nature of public housing lease right. Combined with the problems of public housing lease in real life, this paper expounds that the public housing lease right is a kind of creditor's right with real right and can be inherited. In the course of the research, this paper compares the public housing lease right with the ordinary lease right, the land contract management right and the German long-term residence right system, how to perfect the system of the public housing lease right in our country from the legislation, the judicature and so on. How to establish the inheritance mode of the lease right is put forward, and the protection of the interests of the public housing lessee and the relevant obligee is emphasized. In order to improve the inheritance legal system of public housing rental right, it has certain reference significance.
