信用卡消費者權(quán)益保護問題研究

【摘要】:隨著社會經(jīng)濟的發(fā)展,信用卡逐漸成為了人們生活中經(jīng)常使用的結(jié)算方式,特別是在一線城市,人們?yōu)榱顺鲂蟹矫?多會選擇使用信用卡進行消費。我國信用卡發(fā)展較為緩慢,從1979年至今才逐漸演變成為人們消費過程中的重要支付和結(jié)算手段。信用卡和現(xiàn)金結(jié)算相比較而言,信用卡除了其支付功能之外,還代表著持卡人的信用,其中包含了持卡人的重要信息。但是由于我國發(fā)卡行在信息保護層面沒有進行嚴(yán)格的監(jiān)控與管理,致使很多消費者的信息遭受到了泄漏,從而引起了消費者權(quán)益受到了侵犯。這只是信用卡消費者使用過程中引發(fā)的很小的問題之一,針對信用卡消費者使用過程中權(quán)益被侵犯的情況,本文著重對于我國信用卡消費中存在的問題進行了深入的分析,并提出了信用卡消費者權(quán)益保護的完善對策。文章第一部分,信用卡消費者概述。信用卡消費者概述主要梳理了信用卡的概念,并從建立良好的社會消費體系、幕布現(xiàn)行法律缺失以及提升消費者生活品質(zhì)三個層面分析了加強信用卡消費者權(quán)益法律保護的必要性。第二部分,信用卡消費者權(quán)益保護的現(xiàn)狀及存在的問題。這一部分是文章核心部分,對于信用卡使用過程中,存在侵權(quán)行為進行了深入的分析,并深入學(xué)習(xí)了國外相關(guān)信用卡消費體系的法律規(guī)定,和我國的相關(guān)法律規(guī)定進行了對比,從而得出了在我國可以借鑒的一些經(jīng)驗。第三部分,對我國消費者權(quán)益保護對策的完善。這一部分主要從立法、消費者權(quán)益保護體系、監(jiān)督以及救濟這四個方面,針對我國信用卡消費者使用過程中存在的問題,進行了法律以及制度層面的完善。
[Abstract]:With the development of social economy, credit card has gradually become the settlement method that people often use in their daily life, especially in first-tier cities, people will choose to use credit cards to spend more in order to travel. The development of credit card in China is relatively slow, and it has only gradually evolved into an important means of payment and settlement in the process of people's consumption since 1979. Compared with cash settlement, credit card represents the credit of the cardholder in addition to its payment function, which contains the important information of the cardholder. However, due to the lack of strict monitoring and management in the level of information protection, many consumers' information has been leaked, which has caused the infringement of consumers' rights and interests. This is only one of the minor problems caused by the use of credit card consumers. In view of the infringement of the rights and interests of credit card consumers during the use of credit cards, this paper focuses on the in-depth analysis of the problems existing in the consumption of credit cards in China. And proposed the credit card consumer rights and interests protection consummate countermeasure. The first part of the article is an overview of credit card consumers. The overview of credit card consumers mainly combed the concept of credit card, and from the establishment of a good social consumption system, This paper analyzes the necessity of strengthening the legal protection of credit card consumers' rights and interests from three aspects: the lack of current laws and the improvement of consumers' quality of life. The second part, the credit card consumer rights and interests protection status and existing problems. This part is the core part of the article, for the credit card use process, the existence of tort conduct in-depth analysis, and in-depth study of the relevant foreign credit card consumption system laws and regulations, and the relevant laws and regulations of our country were compared. Thus, some experiences that can be used for reference in our country are obtained. The third part, the consummation to our country consumer rights and interests protection countermeasure. This part mainly from the legislation, consumer rights and interests protection system, supervision and relief of the four aspects, aimed at the problems in the use of credit card consumers in China, the legal and institutional aspects of perfection.
