【摘要】：技術(shù)標準對現(xiàn)代經(jīng)濟社會的發(fā)展具有至關(guān)重要的作用,能有效的提高產(chǎn)品兼容性,增加新技術(shù)傳播的深度和廣度。隨著社會對發(fā)明創(chuàng)造的重視程度不斷提高,專利制度成為保護高新技術(shù)的重要手段,技術(shù)標準對高新技術(shù)的需求使得專利融入標準已成為必然。標準的公共屬性與專利的私權(quán)屬性使得標準必要專利在標準實施過程中與各方利益團體沖突不斷。國際上對于標準必要專利利益沖突的解決主要是通過標準必要專利披露制度、專利權(quán)人“公平、合理、無歧視”的許可承諾制度以及反壟斷機制三種模式,我國標準必要專利的相關(guān)法律規(guī)定較少,鮮有的法律規(guī)定基本屬于照搬國際標準組織的相關(guān)規(guī)定,忽略了公權(quán)力對標準制定與實施的引導(dǎo)與推動作用。公權(quán)力的介入加劇了標準與專利的利益沖突,為了尋求適于解決我國標準必要專利運行中的沖突與矛盾的對策,本文以限制標準必要專利權(quán)人與標準制定者權(quán)利為基礎(chǔ),使國家公權(quán)力的標準制定者承擔更多的義務(wù)為原則,利用利益平衡理論更加合理的分配標準制定者、標準必要專利權(quán)人以及標準實施者三者之間的利益。本文通過以下五部分進行論述:第一部分主要是對標準必要專利基本概念進行界定,第二部分介紹標準必要專利沖突的理論與現(xiàn)狀,第三部分介紹標準必要專利利益協(xié)調(diào)機制的現(xiàn)狀與不足,第四部分介紹我國相關(guān)法律對標準必要專利利益沖突的解決方式,第五部分是針對專利納入標準已經(jīng)成為必然的大背景下,在標準制定的運行中公權(quán)力參與的前提下,構(gòu)建以約束標準制定者為主導(dǎo)同時平衡標準必要專利權(quán)人以及標準實施者之間利益的新模式。
[Abstract]:Technical standards play an important role in the development of modern economy and society, which can effectively improve product compatibility and increase the depth and breadth of new technology dissemination. With the increasing emphasis on invention and creation, patent system has become an important means to protect high and new technology, and the demand of technical standards for high and new technology has made it necessary for patents to be integrated into standards. Standard public attribute and patent private right attribute make standard necessary patent conflict with various interest groups in the process of standard implementation. The international solution to the conflict of interest in standard essential patents is mainly through the standard essential patent disclosure system, the patentee's "fair, reasonable and non-discriminatory" licensing commitment system and the antitrust mechanism. There are few relevant laws and regulations of necessary patent in our country, few of them belong to the relevant provisions of the international standard organization, and neglect the guidance and promotion of the public power to the establishment and implementation of the standard. The intervention of public power intensifies the conflict of interest between the standard and the patent. In order to solve the conflict and contradiction in the operation of the standard necessary patent in our country, this paper is based on restricting the rights of the standard essential patentee and the standard-setter. Make the national public power standard-setters bear more obligations as the principle, use the theory of balance of interests to distribute the interests between the standard-setters, the standard essential patent holders and the standard implementers more reasonably. This paper is discussed in the following five parts: the first part mainly defines the basic concept of standard essential patent, the second part introduces the theory and current situation of standard essential patent conflict. The third part introduces the current situation and deficiency of the coordination mechanism of the standard essential patent interests, the fourth part introduces the ways to solve the conflict of the standard essential patent interest in the relevant laws of our country. The fifth part is in view of the patent incorporation standard has already become the inevitable big background, under the premise of the public power participation in the operation of the standard formulation, A new model of balancing the interests between the necessary patentee and the standard implementers is constructed, which is dominated by binding standard-setters.
