【摘要】：在后稅費時代國家賦權(quán)、地方政府和村社組織讓利、農(nóng)民增權(quán)的農(nóng)村土地利益分配的理想格局中,保護農(nóng)民土地財產(chǎn)權(quán)是其應(yīng)有之意,但農(nóng)村土地利益的不斷增長,刺激了國家、地方政府、村社組織、農(nóng)民對土地利益的激烈博弈。由于國家多重土地目標(biāo)的矛盾和地方政府、村社組織的土地權(quán)力受到制約的有限性,使得土地權(quán)力(權(quán)利)配置與土地利益分配之間并不相稱,從而對農(nóng)民的土地利益進行了擠占,產(chǎn)生了農(nóng)村土地利益分配失衡的狀況。后稅費時代應(yīng)在社會本位價值觀的引領(lǐng)下,尊重農(nóng)民土地財產(chǎn)權(quán)的公私合體屬性,理順國家的土地權(quán)力,約束和規(guī)范地方政府的土地權(quán)力,廓清村社組織的土地權(quán)利,賦予、歸還和維護農(nóng)民的土地權(quán)利。
[Abstract]:In the ideal pattern of the distribution of rural land benefits in the post-tax era, in which local governments and village community organizations give way to profits and farmers increase their rights, the protection of farmers' land property rights is their due meaning, but the increasing interests of rural land, It stimulates the fierce game between the state, local governments, village community organizations and farmers on land interests. Because of the contradiction of the country's multiple land objectives and the local governments, the land power of village organizations is limited. The allocation of land power (rights) is not commensurate with the distribution of land interests, thus crowding out the land interests of farmers. In the post-tax era, we should respect the public and private attributes of peasants' land property rights, and straighten out the land rights of the country, under the guidance of the social standard values. The land rights of local governments should be restricted and standardized, the land rights of village and community organizations should be clarified, and peasants' land rights should be granted, returned and maintained.
