There is a well - known contract: employment contract in drafting of contract law, however, the well- known contract was not stipulated in contract law finally. In recent years, civil law scholars begin to research the problem of employment contract, Labor contract regulated by labor law is a substantial employment contract,however, the distinction between civil law and labor law exist on regulating employment relationship. The article analyse the difference between traditional employment contract and labor contract based on the topic, the different relationship regulated by civil law and labor law is complementary relationship, these laws play a irreplaceable role on the regulation of employment relationship.

《合同法》起草時(shí)曾設(shè)定一類有名合同——雇傭合同,但雇傭合同最終沒有體現(xiàn)在《合同法》中,近年來民法學(xué)界開始涉及雇傭合同問題�！秳趧�(dòng)法》調(diào)整的勞動(dòng)合同實(shí)質(zhì)上也是一種雇傭合同,民法與勞動(dòng)法調(diào)整雇傭關(guān)系有著各自相應(yīng)的區(qū)界。本文對(duì)傳統(tǒng)雇傭契約與勞動(dòng)合同之間存在的差異進(jìn)行了分析,指出民法與勞動(dòng)法所調(diào)整的雇傭關(guān)系是一種互補(bǔ)關(guān)系,兩者在調(diào)整雇傭類社會(huì)關(guān)系中發(fā)揮著不可替代的功能。

Labor Contract Law publicized by General Office of NPC Standing Committee seeking extensive opinions emphasizes the protection to the labors and more rights for the labors in order to balance the relationship between the labor and the capital.But many parts of it needs more careful consideration.

全國人大常委會(huì)辦公廳全文公布《中華人民共和國勞動(dòng)合同法(草案)》(下稱《勞動(dòng)合同法(草案)》),廣泛征求意見。文章認(rèn)為,總體來看,法律草案結(jié)合當(dāng)前勞動(dòng)用工領(lǐng)域存在的不良現(xiàn)象,側(cè)重加大了對(duì)勞動(dòng)者的保護(hù)力度,法律草案賦予了作為弱勢(shì)一方的勞動(dòng)者更多的權(quán)利,從而為平衡勞資關(guān)系提供保障。未來的《勞動(dòng)合同法》將是一部規(guī)范勞動(dòng)用工行為,保護(hù)勞動(dòng)者的合法權(quán)益,處理勞資關(guān)系的重要法律,有許多亮點(diǎn)值得關(guān)注和期待,但同時(shí)也有很多地方值得思考。

The author points out that,at present,there are some problems with corporate social accountability in China,such as the problems of the low rate of contract signing,the labor's interest not being guaranteed,the serious proble ms with labor security and no overtime payment.To protect the lawful rights and interests of the labors,we should,first,introduce labor registration system on the basis of labor contracts;second,intensify law enforcement;third,inten sify the management on quota;fourth,lspeed up development...

The author points out that,at present,there are some problems with corporate social accountability in China,such as the problems of the low rate of contract signing,the labor's interest not being guaranteed,the serious proble ms with labor security and no overtime payment.To protect the lawful rights and interests of the labors,we should,first,introduce labor registration system on the basis of labor contracts;second,intensify law enforcement;third,inten sify the management on quota;fourth,lspeed up development of the social security system;and fifth,formulate Labor Contract Law,The Settlement of Labor Disp utes Law,The Promotion of Employment Law,and improve the Labor Law.

本文認(rèn)為,中國在成為“世界工廠”的同時(shí),勞工問題也日益突出,并被國際社會(huì)所關(guān)注。目前我國企業(yè)在社會(huì)責(zé)任方面存在的問題,集中表現(xiàn)在侵害勞動(dòng)者合法權(quán)益現(xiàn)象嚴(yán)重,如簽訂勞動(dòng)合同的比率很低,勞動(dòng)者的經(jīng)濟(jì)利益得不到保障,勞動(dòng)條件惡劣、勞動(dòng)安全問題嚴(yán)重,不支付加班工資,勞動(dòng)者的生存權(quán)受到侵害等。文章提出,為維護(hù)勞動(dòng)者權(quán)益,第一,要在全國范圍內(nèi)推行以簽訂勞動(dòng)合同為基礎(chǔ)的勞動(dòng)用工登記制度。第二,各級(jí)政府和部門要加大執(zhí)法力度,嚴(yán)厲查處拒不執(zhí)行最低工資規(guī)定的用人單位。第三,勞動(dòng)保障部門要加強(qiáng)對(duì)勞動(dòng)定額標(biāo)準(zhǔn)的管理,建立和完善日常監(jiān)察制度。第四,加快社會(huì)保障制度建設(shè),抓緊解決進(jìn)城務(wù)工人員參保問題。第五,要加快制訂《勞動(dòng)合同法》、《社會(huì)保險(xiǎn)法》、《勞動(dòng)爭(zhēng)議處理法》、《就業(yè)促進(jìn)法等法律》,修改完善《勞動(dòng)法》。
