【摘要】：正 1989年底,最高人民法院頒布實(shí)施的《關(guān)于人民法院審理未辦理結(jié)婚登記而以夫妻名義同居生活案件的若干意見(jiàn)》。意見(jiàn)的第7條規(guī)定:“未辦結(jié)婚登記而以夫妻名義同居生活的男女,一方要求“離婚”或解除同居關(guān)系,經(jīng)查確屬非法同居關(guān)系的,應(yīng)一律判決予以解除。”筆者認(rèn)為,對(duì)非法同居關(guān)系必須一律予以解除,但不一定非要
[Abstract]:At the end of 1989, the Supreme people's Court promulgated some opinions on the trial of cases of cohabitation in the name of husband and wife by the people's Court. Article 7 of the opinion states: "A man or woman who has not registered a marriage and cohabited in the name of a husband and wife, if one of the parties requests' divorce'or the dissolution of a cohabitation relationship, if it is found to be illegal, shall give the same decision." The author believes that the illegal cohabitation relationship must all be dissolved, but it does not have to be necessary.
