【摘要】：家庭,是社會(huì)最基本、最重要的組成細(xì)胞,婚姻則是家庭的基礎(chǔ)。民主制的實(shí)行增強(qiáng)了人們的民主意識(shí)�；橐鲎杂沙蔀楣竦囊豁�(xiàng)基本權(quán)利。目前,面對(duì)我國(guó)日益畸高的離婚率與復(fù)婚率,以及相當(dāng)比例的輕率離婚等婚姻家庭現(xiàn)狀,我們必須要站在適當(dāng)限制這種自由權(quán)的角度,尋求建立一種離婚障礙機(jī)制,賦予離婚自由主體不可或缺的法律保障與限制,同時(shí)也為解決大量離婚司法實(shí)踐問(wèn)題探尋出一條解決途徑。引進(jìn)別居制度無(wú)疑不是一個(gè)妥善的選擇。本文運(yùn)用了大量的歷史研究法、統(tǒng)計(jì)比較分析法,同時(shí)結(jié)合實(shí)證研究法,從離婚自由權(quán)及適當(dāng)限制、我國(guó)現(xiàn)行離婚制度的反思、別居制度的價(jià)值、我國(guó)建立別居制度的必要性、我國(guó)建立別居制度的立法建議五個(gè)方面進(jìn)行了分析研究,僅希望能以此文為我國(guó)的婚姻家庭法律體系的完善盡自己的一份綿薄之力。
[Abstract]:Family, is the most basic, the most important components of the cell, marriage is the basis of the family. The implementation of democracy has strengthened people's democratic consciousness. Freedom of marriage becomes a fundamental right of citizens. At present, in the face of the increasingly high divorce and remarriage rates in our country, as well as the considerable proportion of hasty divorces and other marital and family situations, we must seek to establish an obstacle mechanism for divorce from the angle of appropriately restricting this right of freedom. At the same time, it can find a way to solve a large number of judicial problems of divorce. Introduction of alternative residence system is no doubt not a good choice. In this paper, a large number of historical research methods, statistical comparative analysis, combined with empirical research method, from divorce freedom and appropriate restrictions, China's current divorce system reflection, the value of the system, the necessity of establishing a separate residence system in China. In this paper, the author analyzes and studies five aspects of the legislative proposals for the establishment of alternative residence system in China, and only hopes that this article can do its utmost for the perfection of the legal system of marriage and family in our country.
