【摘要】：現(xiàn)行法律制度無法提供非離婚條件下配偶間民事?lián)p害賠償救濟(jì),從而置家庭暴力受害者于尷尬境地,應(yīng)當(dāng)加以解決。本文剖析了導(dǎo)致婚內(nèi)損害賠償受阻的立法,司法解釋等法律癥結(jié),厘清了婚內(nèi)人身損害賠償制度與家庭財產(chǎn)制度及離婚損害賠償制度之間的關(guān)系,提出了增加非常財產(chǎn)制度、修改有關(guān)司法解釋等解決婚內(nèi)損害賠償問題的具體思路。
[Abstract]:The current legal system can not provide the relief of civil damages between spouses under the condition of non-divorce, thus putting the victims of domestic violence in an awkward situation, which should be solved. This paper analyzes the legislative and judicial interpretation of the obstructed marital damages, clarifies the relationship between the marital personal injury compensation system, the family property system and the divorce damage compensation system, and proposes to increase the extraordinary property system. Revise the relevant judicial interpretation to solve the problem of compensation for marital damage specific ideas.
