【摘要】：涉少家事案件未成年子女的權(quán)益保護(hù),有兩種不同的模式,一是傳統(tǒng)的家庭保護(hù)模式,二是法院介入家庭內(nèi)部保護(hù)。前者某些情況下會侵害未成年人子女的權(quán)益,但法院介入家庭內(nèi)部保護(hù)面臨著信息不充分的困境。成都市中級人民法院在我國現(xiàn)行民事訴訟法沒有規(guī)定家事程序的情況,通過社會關(guān)護(hù)員參與調(diào)解的方式保護(hù)未成年子女的利益,以社會參與的方式實(shí)現(xiàn)了國家保護(hù)與家庭保護(hù)沖突的融合,是人民司法傳統(tǒng)在涉少家事案件中的繼承和發(fā)揚(yáng)。
[Abstract]:There are two different models for the protection of the rights and interests of minor children in minor family cases, one is the traditional family protection mode, the other is the court intervention in the family internal protection. The former may infringe upon the rights and interests of minor children under certain circumstances, but the court's intervention in the protection of the family faces the dilemma of insufficient information. The Chengdu Intermediate people's Court has not stipulated the procedure of family affairs in the current civil procedure law of our country, and it protects the interests of minor children through the participation of social security guards in mediation. The fusion of the conflict between state protection and family protection is realized by the way of social participation, which is the inheritance and development of the people's judicial tradition in the cases involving few family matters.
