【摘要】： 本文以我國監(jiān)護(hù)制度為研究對象,通過對不同時(shí)期監(jiān)護(hù)法文化特質(zhì)的分析,以總結(jié)我國監(jiān)護(hù)制度的發(fā)展規(guī)律,最終討論我國監(jiān)護(hù)制度的未來發(fā)展。在我國監(jiān)護(hù)制度演變的過程中,政治決定了我們在不同時(shí)期的法文化選擇,而經(jīng)濟(jì)對這種選擇的結(jié)果會產(chǎn)生重要的影響。監(jiān)護(hù)法文化特質(zhì)的變化與倫理道德有著密切的關(guān)系。通過對法文化特質(zhì)的影響,我們可以促進(jìn)監(jiān)護(hù)制度的發(fā)展。在我國現(xiàn)時(shí)期,政治和經(jīng)濟(jì)保持著協(xié)調(diào)發(fā)展,法文化整體發(fā)展呈現(xiàn)出良好趨勢,公民法律意識也在不斷提高,這些都是我國監(jiān)護(hù)制度演變過程中未曾完全表現(xiàn)出來的積極因素,它們?yōu)槲覈O(jiān)護(hù)制度的未來發(fā)展創(chuàng)造了有利的條件。在這樣的情況下,我們應(yīng)通過豐富監(jiān)護(hù)法文化特質(zhì)的方式來促進(jìn)我國監(jiān)護(hù)制度的發(fā)展。
[Abstract]:This article takes our country guardianship system as the research object, through the analysis to the different period guardianship law culture characteristic, summarizes our country guardianship system development law, finally discusses our country guardianship system future development. In the course of the evolution of the guardianship system in China, politics determines our choice of legal culture in different periods, and the economy will have an important influence on the outcome of this choice. The change of cultural characteristics of guardianship law is closely related to ethics. Through the influence on legal culture, we can promote the development of guardianship system. In the present period of our country, politics and economy are developing harmoniously, the overall development of law and culture is showing a good trend, and the citizen's legal consciousness is also constantly improving. These are all positive factors that have not been fully manifested in the evolution of our guardianship system. They have created favorable conditions for the future development of China's guardianship system. In this case, we should enrich the cultural characteristics of guardianship law to promote the development of our guardianship system.
