【摘要】：　南非新憲法對(duì)其司法制度的變革作了原則性規(guī)定 ,使之?dāng)[脫了種族主義的桎梏 ,但其民主化仍任重道遠(yuǎn)。新南非法注重保護(hù)公民權(quán)利 ,加快與國際慣例接軌 ,婚姻家庭法的改革仍是重點(diǎn) ,死刑存廢的爭論還將延續(xù) ,憲法法院的裁決和最高法院的司法解釋在南非法的未來發(fā)展中將發(fā)揮重要作用。
[Abstract]:The new constitution of South Africa provides for the reform of its judicial system in principle, which makes it free from the shackles of racism, but its democratization still has a long way to go. Xinnan unlawfully pays attention to the protection of citizens' rights and speeds up its integration with international practice. The reform of marriage and family law is still the focus, and the controversy over the existence and abolition of the death penalty will continue. The ruling of the Constitutional Court and the judicial interpretation of the Supreme Court will play an important role in the future development of South African law.
