【摘要】： 少數(shù)民族地區(qū)的重婚問(wèn)題,因長(zhǎng)期形成的民族習(xí)慣,婚姻習(xí)俗,以及長(zhǎng)期的封閉,欠發(fā)展,形成了自己的特點(diǎn),隨著經(jīng)濟(jì)的發(fā)展,對(duì)外交往的增多,外來(lái)影響的加劇,少數(shù)民族地區(qū)的重婚犯罪問(wèn)題又與漢族地區(qū)呈現(xiàn)出許多共同的特點(diǎn)。據(jù)調(diào)查數(shù)據(jù)顯示,黔東南苗族侗族自治州的重婚犯罪呈現(xiàn)的特點(diǎn):一是以事實(shí)婚姻的形式重婚是重婚犯罪的主要趨勢(shì);二是少數(shù)民族是民族地區(qū)重婚犯罪的主要主體;三是30歲-50歲是民族地區(qū)涉嫌重婚犯罪的主要年齡段;四是農(nóng)民占涉嫌重婚犯罪主體的多數(shù);五是男性和女性涉嫌重婚犯罪比例基本持平;六是對(duì)重婚犯罪的刑罰處罰輕緩;七是公訴重婚案件有罪判決率高。通過(guò)調(diào)查同時(shí)也發(fā)現(xiàn)我們?cè)诮鉀Q重婚犯罪問(wèn)題時(shí)存在的不足:一是刑法及相關(guān)司法解釋與婚姻法規(guī)相沖突;二是民族習(xí)慣與婚姻法的沖突;三是撤訴與打擊重婚犯罪相沖突;四是輕緩刑罰處罰與刑法目的相沖突。為更好地解決重婚犯罪問(wèn)題,有必要借鑒好的經(jīng)驗(yàn)和做法,借鑒我國(guó)歷史上解決重婚問(wèn)題的成功經(jīng)驗(yàn),借鑒外國(guó)好的經(jīng)驗(yàn)和做法,從立法的、司法的和行政的途徑入手,構(gòu)建解決重婚犯罪問(wèn)題的路徑。
[Abstract]:The problem of bigamy in ethnic minority areas has formed its own characteristics because of its long-standing ethnic habits, marriage customs, and long period of closure and underdevelopment. With the development of the economy, the increase in foreign exchanges and the intensification of external influence, The crime of bigamy in minority areas and Han nationality areas show many common characteristics. According to the investigation data, the characteristics of bigamy crime in Qiandongnan Miao and Dong Autonomous Prefecture are as follows: first, bigamy in the form of de facto marriage is the main trend of bigamy crime; Third, 30-50 years old is the main age of bigamy crime in ethnic areas; fourth, farmers account for the majority of suspected bigamy crime subjects; fifthly, the proportion of men and women suspected of bigamy crime is basically equal; sixth, the penalty for bigamy crime is light; Seventh, the conviction rate of bigamy cases is high. At the same time, we find that we have some shortcomings in solving the problem of bigamy crime: first, the conflict between criminal law and related judicial interpretation and marriage law; second, the conflict between national custom and marriage law; third, the conflict between withdrawing prosecution and cracking down on bigamy crime; Fourth, the light penalty and the purpose of criminal law conflict. In order to better solve the problem of bigamy, it is necessary to draw lessons from good experiences and practices, draw lessons from the successful experience in solving bigamy problems in the history of our country, and draw lessons from good experiences and practices of foreign countries, starting with legislative, judicial and administrative approaches. Construct the path to solve the problem of bigamy crime.
