Abstract Divorce is the legal means to renounce a marriage.Its formality,legal reasons and legal consequences are provided for by laws both in inland China and Macao.Generally and comparatively speaking,laws in inland China are simpler than those in Macao,and the latter are worth referring to in the revision of Marriage Law in inland China.

This paper brings out problems in the trials of husband-and-wife shared debt along with devotee lawsuit. It puts forward proposals of separating the trial of shaced debt from that of the devorce lawsuit, and when necessary, carrying out the former alone. It finally suggests to revise the 32nd item of the Marriage Law.

分析人民法院在審判離婚案件時(shí),一并審理夫妻共同債務(wù)的法律依據(jù)及其積極作用,并從不合法理、可能損害債權(quán)人利益、拖延離婚案件的審結(jié)時(shí)間等五方面提出了質(zhì)疑。提出將離婚訴訟中確定夫妻共同債務(wù)承擔(dān)的審理與離婚訴訟相分離,必要時(shí)作為債務(wù)案件單獨(dú)審理的主張并論證其合理性,由此提出了對(duì)現(xiàn)行《婚姻法》第32條的修改建議。
