【摘要】：眾所周知,家庭是最基本的社會(huì)單位和經(jīng)濟(jì)單位,夫妻關(guān)系是社會(huì)基本的人倫關(guān)系,因此對(duì)調(diào)整夫妻身份關(guān)系的配偶權(quán)的研究不僅關(guān)系到夫妻雙方的利益,而且還關(guān)系到家庭中其他成員的利益,關(guān)系到全社會(huì)的利益——社會(huì)的穩(wěn)定、經(jīng)濟(jì)的發(fā)展和道德體系的維系。 配偶權(quán)是一種身份權(quán),這已得到學(xué)術(shù)界的普遍認(rèn)可。在比較了關(guān)于配偶權(quán)的各種學(xué)說(shuō)后,對(duì)配偶權(quán)的概念進(jìn)行了概括,認(rèn)為配偶權(quán)是夫妻雙方基于合法婚姻關(guān)系而依法享有的,以夫妻身份利益為客體的,平等專屬支配其身份利益,對(duì)方及其他任何人均不得侵犯的身份權(quán)利。通過(guò)對(duì)配偶權(quán)的概念、法律特征、具體內(nèi)容進(jìn)行論述,使我們對(duì)配偶權(quán)有了更深層次的了解。 侵害配偶權(quán)屬一般侵權(quán)行為,在構(gòu)成上同樣具備四個(gè)要件。在分類探討了配偶權(quán)侵權(quán)行為后,對(duì)侵害配偶權(quán)的法律責(zé)任進(jìn)行了闡述。最后,分析了我國(guó)現(xiàn)行法律對(duì)配偶權(quán)保護(hù)存在的不足,并就如何完善我國(guó)配偶權(quán)立法提出了建議。
[Abstract]:As we all know, the family is the most basic social unit and economic unit, and the relationship between husband and wife is the basic relationship of human relations. Therefore, the study on the right of spouse to adjust the relationship between husband and wife is not only related to the interests of both husband and wife. It also concerns the interests of other members of the family, the interests of the whole society-social stability, economic development and the maintenance of the moral system. The right to spouse is a right of identity, which has been generally recognized by the academic community. After comparing various theories about spouse right, this paper generalizes the concept of spouse right, and holds that spouse right is legally enjoyed by both husband and wife on the basis of legal marital relationship, and takes the interest of husband and wife as the object. Equal exclusive control of their identity interests, the other party and any other person shall not violate the right to identity. Through discussing the concept, legal characteristics and concrete contents of the right of spouse, we have a deeper understanding of the right of spouse. Infringing on spouse's right belongs to general tort act, also has four elements in constitution. After classifying and discussing the tort of spouse right, the legal liability of infringing spouse right is expounded. Finally, the paper analyzes the deficiency of the existing law on the protection of the right of spouse, and puts forward some suggestions on how to perfect the legislation of the right of spouse in our country.
