【摘要】：監(jiān)護(hù)人確定制度在整個(gè)監(jiān)護(hù)制度中占有重要地位,建立先進(jìn)、完備的監(jiān)護(hù)人制度是保護(hù)未成年人和無(wú)民事行為能力、限制民事行為能力成年人合法權(quán)益的關(guān)鍵性制度。由于我國(guó)《民法通則》中設(shè)立了并不符合國(guó)情的“村民委員會(huì)、居民委員會(huì)”等擔(dān)任法定監(jiān)護(hù)人的制度,經(jīng)常出現(xiàn)監(jiān)護(hù)人“落空”,另外隨著社會(huì)的發(fā)展,高齡化人口的銳增等各種社會(huì)現(xiàn)象的出現(xiàn),成年人的監(jiān)護(hù)人制度的設(shè)立也勢(shì)在必行。因此,設(shè)立監(jiān)護(hù)人確定的補(bǔ)救制度確有必要。本文通過(guò)分析監(jiān)護(hù)制度的法理基礎(chǔ),比較、評(píng)價(jià)大陸法系和英美法系中有關(guān)監(jiān)護(hù)制度的相關(guān)立法,對(duì)完善我國(guó)的監(jiān)護(hù)人確定制度提出了自己的立法建議,筆者認(rèn)為應(yīng)修改我國(guó)現(xiàn)行的監(jiān)護(hù)立法,不僅要在體例上重新調(diào)整,而且還需完善監(jiān)護(hù)人的種類、明確監(jiān)護(hù)人的任職資格,賦予監(jiān)護(hù)人享有報(bào)酬、辭任權(quán),并應(yīng)增設(shè)公職監(jiān)護(hù)人、設(shè)立監(jiān)護(hù)監(jiān)督人的有關(guān)規(guī)定。文章最后明確提出了確定監(jiān)護(hù)人應(yīng)遵循的順序及方式,并指出對(duì)監(jiān)護(hù)人的監(jiān)督可由近親屬、居民委員會(huì)、村民委員會(huì)、民政部門下屬機(jī)構(gòu)擔(dān)任,人民法院統(tǒng)一監(jiān)督的層層制約的方式。
[Abstract]:The system of guardian determination plays an important role in the whole guardianship system. The establishment of advanced and complete guardian system is the key system to protect minors and have no capacity for civil conduct and limit the legitimate rights and interests of adults. As the "villagers' committee, residents' committee" and other legal guardian systems, which are not in line with the national conditions, have been set up in the "General principles of Civil Law" in our country, the guardian often "fails". In addition, with the development of the society, With the emergence of various social phenomena, such as the rapid increase of aging population, the establishment of adult guardian system is imperative. Therefore, it is necessary to establish a remedy system determined by the guardian. By analyzing the legal basis of guardianship system, comparing and evaluating the relevant legislation of guardianship system in civil law system and Anglo-American law system, this paper puts forward some legislative suggestions to perfect the guardian determination system in our country. The author thinks that the current guardianship legislation of our country should be revised, not only to readjust the style of guardianship, but also to perfect the type of guardian, to define the qualification of guardian, to give the guardian the right of remuneration and resignation, and to add the public guardian. Relevant provisions on the Establishment of Guardianship Supervisors. At the end of the article, it is pointed out clearly that the order and method of determining the guardian should be followed, and that the supervision of the guardian may be served by the close relatives, the residents' committee, the villagers' committee, and the subordinate organs of the civil affairs department. The people's court unifies the supervision layer by layer restriction way.
