漢、唐戶婚之律比較研究

【摘要】: 張家山漢簡中《二年律令》里的戶律、傅律、置后律的內(nèi)容與《唐律疏議》中的戶婚律內(nèi)容基本一致,但漢律律文性質(zhì)多為民事性質(zhì)與唐律的刑律有很大不同。本篇論文以實證研究的方法,對漢、唐戶(婚)律的內(nèi)容進行比較,以期找出我國古代戶(婚)律的發(fā)展特點。通過從戶籍管理及相關法律制度、繼承管理制度、婚姻管理制度這三方面的內(nèi)容比較,可以得出由漢至唐其戶婚之律的發(fā)展特點主要有三方面:一是禮在律中的深入發(fā)展;二是宗法精神在律中的體現(xiàn);三是戶(婚)律地位及內(nèi)容的發(fā)展。并總結出戶婚律逐步轉變成為刑事規(guī)范是我國古代宗法思想和“禮”文化作用下的必然結果,是中國古代“個體”意識淡薄的體現(xiàn)。
[Abstract]:In Zhang Jiashan's Han slips, the contents of the household law, Fu law and the law after the introduction are basically the same as the contents of the law of marriage in the book of the Tang Dynasty, but the nature of the law of the Han Dynasty is mostly civil and the criminal law of the Tang Dynasty is very different from that of the law of the Tang Dynasty. This paper compares the contents of the laws of marriage in Han and Tang dynasties with the method of empirical research in order to find out the characteristics of the development of the laws of marriage in ancient China. By comparing the contents of household registration management and related legal system, inheritance management system and marriage management system, it can be concluded that there are three main characteristics of the development of the law of marriage from Han Dynasty to Tang Dynasty: first, the further development of ritual in the law; The second is the embodiment of patriarchal spirit in the law, and the third is the development of the legal status and content of the household (marriage) law. It is concluded that the gradual transformation of the household marriage law into a criminal norm is the inevitable result of the ancient patriarchal thought and the "ritual" culture of our country, and is the embodiment of the weak consciousness of the "individual" in ancient China.
